近年來,在全球化趨勢(shì)和一帶一路倡議的推動(dòng)下,法律翻譯受到了較多的關(guān)注。但目前國(guó)內(nèi)對(duì)法律翻譯的研究主要集中于立法文本和判決書,學(xué)術(shù)文章作為法學(xué)研究成果展示的重要途徑、了解國(guó)際學(xué)術(shù)研究趨勢(shì)的重要渠道,顯然沒有得到應(yīng)有的重視。在本次翻譯實(shí)踐中,譯者選取《數(shù)據(jù)時(shí)代版權(quán)維權(quán)問題:補(bǔ)救機(jī)制不當(dāng)》一文作為翻譯材料。該文章通過對(duì)美國(guó)版權(quán)法規(guī)定的法定賠償金進(jìn)行實(shí)證研究,指出目前美國(guó)版權(quán)侵權(quán)索賠存在的問題,并提出了幾點(diǎn)創(chuàng)造性的意見,對(duì)我國(guó)版權(quán)保護(hù)具有一定的借鑒意義。本報(bào)告結(jié)合源文本的文本類型和特點(diǎn),從詞匯、句子和篇章三個(gè)層面對(duì)此次翻譯實(shí)踐進(jìn)行分析,并以譯者主體性為指導(dǎo),具體討論了含法律意義常用詞匯、合成詞、長(zhǎng)難句、否定句及注釋的翻譯,以期為之后法律學(xué)術(shù)文本的翻譯提供參考。分析發(fā)現(xiàn),詞匯翻譯,尤其是含法律意義常用詞匯的翻譯,需特別注意借助語境分析,避免因慣性思維產(chǎn)生誤解;而句子翻譯則要重點(diǎn)考慮譯入語的語言習(xí)慣,其中翻譯否定句時(shí)還需根據(jù)原文的語氣在正譯與反譯之間做出選擇;對(duì)于學(xué)術(shù)論文注釋的翻譯,還需參考譯入語對(duì)應(yīng)領(lǐng)域的權(quán)威期刊進(jìn)行處理,并根據(jù)具體情況進(jìn)行加注。
