【摘要】：口頭文化遺產(chǎn)對于無文字民族至關(guān)重要,但是在現(xiàn)代社會中對于相關(guān)文化遺產(chǎn)的不當開發(fā)或冒犯行為時有發(fā)生。作為民族重要的文化知識,知識產(chǎn)權(quán)是口頭文化遺產(chǎn)搶救與保護的重要視角,而由于知識產(chǎn)權(quán)的源起訴求并不是針對民族傳統(tǒng)文化知識保護,知識產(chǎn)權(quán)法關(guān)于口頭文化遺產(chǎn)的搶救與保護應(yīng)用還存在一定不足�；谝陨锨闆r,知識產(chǎn)權(quán)視角下無文字民族的口頭文化遺產(chǎn)搶救與保護既要重視知識產(chǎn)權(quán)制度的適用,盡可能地使更多的口頭文化遺產(chǎn)能夠應(yīng)用知識產(chǎn)權(quán)制度來保護,還需要和其他行政手段相結(jié)合,形成包括知識產(chǎn)權(quán)制度在內(nèi)的綜合保護體系。
[Abstract]:Oral cultural heritage is of great importance to non-literate peoples, but improper exploitation or offending of related cultural heritage occurs from time to time in modern society. As an important cultural knowledge of a nation, intellectual property right is an important angle of view to save and protect oral cultural heritage. However, the origin of intellectual property right is not aimed at the protection of national traditional cultural knowledge. The application of intellectual property law to the rescue and protection of oral cultural heritage is still insufficient. Based on the above situation, we should attach importance to the application of intellectual property system and make more oral cultural heritage can be protected by intellectual property system in the perspective of intellectual property rights. It also needs to combine with other administrative means to form a comprehensive protection system, including intellectual property system.
