【摘要】: 在治理污染、保護環(huán)境的過程中,傳統(tǒng)的“命令——控制型”控制手段由于是政府的單方面行為,缺乏環(huán)境治理相對人的參與,在很大程度上限制了其實施的效果,在解決日益復(fù)雜的環(huán)境問題上,該模式顯示出后繼乏力的頹勢。而排污權(quán)交易作為一項環(huán)境治理的政策工具,在國外已經(jīng)得到普遍運用,由于其充分發(fā)揮了市場經(jīng)濟的優(yōu)勢,能夠有效的控制和減少污染物排放,也受到我國學(xué)界的關(guān)注。 然而,排污權(quán)作為確立排污權(quán)交易基礎(chǔ),對其內(nèi)涵和性質(zhì)的研究,特別是從法學(xué)意義上的界定仍顯單薄。目前我國學(xué)界對排污權(quán)名稱界定上就存在分歧,對其性質(zhì)也存在“公權(quán)說”、“私權(quán)說”、“資格說”等學(xué)說。 本文回顧和反思了學(xué)界對排污權(quán)內(nèi)涵界定的基礎(chǔ),概括和歸納了學(xué)界對排污權(quán)認識上的共識,以便于排污權(quán)進入立法為目的,就排污權(quán)的性質(zhì)予以深入的探討,認為排污權(quán)不是一種單一內(nèi)容的權(quán)利,并非僅是指對環(huán)境容量的使用權(quán),而是排污資格與環(huán)境容量使用權(quán)的雙重復(fù)合,有別于通說認為的民事權(quán)利,也不是純粹的行政法意義上的排污許可,并通過界定排污權(quán)的特征和調(diào)整排污許可證取得程序的方法協(xié)調(diào)了排污交易與行政法之間的矛盾;通過解釋的方法,重新梳理了民法上物的概念,使環(huán)境容量作為一種“物”、環(huán)境容量使用權(quán)成為物權(quán),進而將排污權(quán)納入到民法的調(diào)整范圍,消除了排污權(quán)立法的民法障礙。
[Abstract]:In the process of pollution control and environmental protection, the traditional "command-control" control method is a unilateral act of the government and lacks the participation of the relative person in environmental governance, which limits to a great extent the effect of its implementation. In solving the increasingly complex environmental problems, the model shows a declining trend of subsequent weakness. As a policy tool of environmental governance, emissions trading has been widely used abroad, because of its full play of the advantages of the market economy. Can effectively control and reduce pollutant emissions, but also by the academic community in China. However, as the basis for establishing the trading of emission rights, the research on the connotation and nature of emission rights, especially from the legal sense of the definition is still weak. At present, there are differences in the definition of the name of emission rights in Chinese academic circles. There are some theories about its nature, such as public right theory, private right theory and qualification theory. This paper reviews and reflects on the basis of defining the connotation of emission rights in academic circles, summarizes and sums up the consensus on the understanding of emission rights in academic circles, and makes a thorough discussion on the nature of emission rights in order to facilitate the introduction of emission rights into legislation. The author thinks that the pollution discharge right is not a kind of single content right, it is not only the right to use the environmental capacity, but also the dual compound of the pollution discharge qualification and the environmental capacity right, which is different from the civil rights thought by the general theory. Nor is it purely administrative law about emission permits, and the contradiction between emissions trading and administrative law is reconciled by defining the characteristics of emission rights and adjusting the procedures for obtaining emission permits; by means of interpretation, This paper reorganizes the concept of things in civil law, makes the environmental capacity as a kind of "thing", and the right to use environmental capacity becomes the real right, and then brings the pollution discharge right into the adjustment scope of the civil law, and eliminates the obstacles of civil law in the legislation of pollution discharge right.
