論環(huán)境行政合同制度

【摘要】:環(huán)境行政合同最早產(chǎn)生于日本,在日本被稱為公害防止協(xié)定。公害防止協(xié)定的運(yùn)用極大地改善了日本的環(huán)境污染狀況。現(xiàn)在,世界各國尤其是在歐美日等發(fā)達(dá)國家,行政合同在環(huán)境管理領(lǐng)域已得到廣泛應(yīng)用,并發(fā)揮著重要的作用。環(huán)境行政合同順應(yīng)了行政民主化的潮流,使相對人真正參與到了行政管理過程中,他們的意志得到了充分的尊重。由于相對人的合作,環(huán)境行政效率大大提高,,成本大幅下降。但是,環(huán)境行政合同在實(shí)踐中仍然存在很多問題,因此對環(huán)境行政合同進(jìn)行深入的研究很有必要。 本文分為環(huán)境行政合同基本理論探析、中外環(huán)境行政合同制度的比較借鑒和我國環(huán)境行政合同制度的構(gòu)建三個(gè)部分。在第一部分中,對環(huán)境行政合同的概念給予了重新的界定,并詳細(xì)闡述了它與市場經(jīng)濟(jì)、行政民主化及可持續(xù)發(fā)展之間的關(guān)系。旨在進(jìn)一步完善我國的環(huán)境行政合同理論。第二部分,在對一些國家的環(huán)境行政合同制度進(jìn)行比較的基礎(chǔ)上,找出可以為我國所借鑒的經(jīng)驗(yàn)。第三部分從環(huán)境行政合同的程序、實(shí)體權(quán)利義務(wù)、違約責(zé)任及其救濟(jì)方面構(gòu)筑起我國環(huán)境行政合同制度的基本框架,尤其突出環(huán)境行政合同的救濟(jì)制度,因?yàn)閷Υ宋覈姆煞ㄒ?guī)中幾乎沒有規(guī)定。學(xué)者的研究對象也僅限于平等民事主體之間環(huán)境糾紛,環(huán)境行政合同糾紛未納入研究的范圍。最后,鑒于我國還沒有統(tǒng)一的環(huán)境行政合同法,本文提出了關(guān)于環(huán)境行政合同的立法模式的建議。
[Abstract]:The environmental administrative contract originated in Japan and is called the pollution prevention agreement in Japan. The application of the environmental pollution prevention agreement has greatly improved the environmental pollution situation in Japan. Now, all countries in the world, especially in Europe, America and Japan and other developed countries, Administrative contract has been widely used in the field of environmental management and plays an important role. Environmental administrative contract conforms to the trend of administrative democratization and makes the relative person participate in the process of administration. Their will has been fully respected. As a result of the cooperation of relative parties, the environmental administrative efficiency has been greatly improved and the cost has been greatly reduced. However, there are still many problems in the practice of environmental administrative contracts. Therefore, it is necessary to study the environmental administrative contract deeply. This paper is divided into three parts: the analysis of the basic theory of environmental administrative contract, the comparison between Chinese and foreign environmental administrative contract system and the construction of environmental administrative contract system in China. In the first part, the concept of environmental administrative contract is redefined. The relationship between it and market economy, administrative democratization and sustainable development is expounded in detail. The purpose is to further improve the theory of environmental administrative contract in China. Based on the comparison of the environmental administrative contract system in some countries, the author finds out the experience that can be used for reference by our country. The third part is about the procedure of environmental administrative contract, the rights and obligations of the entity. The liability for breach of contract and its relief form the basic framework of our country's environmental administrative contract system, especially the relief system of environmental administrative contract. The research object of scholars is also limited to environmental disputes between equal civil subjects, and environmental administrative contract disputes are not included in the scope of study. Finally, In view of the fact that there is no uniform environmental administrative contract law in China, this paper puts forward some suggestions on the legislative model of environmental administrative contract.
