【摘要】：改革開放以來,我國科技得以迅速發(fā)展,人民生活水平也得到提高,但環(huán)境污染與生態(tài)破壞問題也在加劇。我國頒布的《環(huán)境保護法》等法律法規(guī)對防治環(huán)境污染和改善生態(tài)環(huán)境起了很大的作用。伴隨著社會文明的進步和全民環(huán)保意識的提高,我國《行政處罰法》首次在法律上引進了聽證的概念,開創(chuàng)了聽證程序在我國的先河,此后環(huán)保部頒布的《環(huán)境行政處罰辦法》是《行政處罰法》在環(huán)保領域的細化,規(guī)范了環(huán)保部門的行政處罰程序、推動了環(huán)境執(zhí)法工作。但《行政處罰法》和《環(huán)境行政處罰辦法》中關于聽證的規(guī)定過于粗糙,缺乏詳細的配套性規(guī)定,存在較大的缺陷。隨著環(huán)境執(zhí)法力度的加大以及公眾法律意識的提升,適用聽證程序的案件也在逐年增長,環(huán)保部于2010年專門制定并發(fā)布了《環(huán)境行政處罰聽證程序規(guī)定》來細化聽證規(guī)定,強化可操作性。 環(huán)保部頒布的《環(huán)境行政處罰聽證程序規(guī)定》進一步細化了環(huán)境行政處罰聽證程序,對環(huán)境行政聽證程序中聽證的原則、范圍、適用條件以及聽證的提出、舉行等內(nèi)容作出了詳細規(guī)定；并突出保障當事人的合法權(quán)益,對聽證程序的適用范圍進行細化,明確了聽證主持人的內(nèi)容,使聽證程序的可操作性更強。雖然《環(huán)境行政處罰聽證程序規(guī)定》的頒布凸顯了自身的優(yōu)勢和進步,但還存在諸如聽證主持人的規(guī)定不完善、聽證筆錄相關內(nèi)容的規(guī)定簡單、聽證程序物質(zhì)保障制度不足以及未強調(diào)非政府環(huán)保組織參與聽證等問題,畢竟環(huán)境行政處罰聽證程序研究是一個比較新興的課題,針對這些問題,我們要對聽證主持人的規(guī)定進行完善,并針對聽證筆錄的問題提出相應的對策,通過設立專項資金支撐環(huán)境行政處罰聽證的物質(zhì)保障,提升非政府環(huán)保組織參與聽證的作用。隨著國家對環(huán)保事業(yè)的重視,特別是黨的十八大及十八屆三中全會以來,國家把生態(tài)文明建設放在突出地位,并融入經(jīng)濟建設、政治建設、文化建設、社會建設各方面和全過程,生態(tài)文明建設已經(jīng)進入國家經(jīng)濟社會發(fā)展的全局,環(huán)境行政處罰聽證作為環(huán)境保護事業(yè)的重要內(nèi)容和公共事務的重要部分,在全國范圍內(nèi)也得到了提升。
[Abstract]:Since the reform and opening up, science and technology in China have developed rapidly, and the living standards of the people have also been improved. However, the problems of environmental pollution and ecological destruction are also aggravated. The laws and regulations promulgated by our country, such as the Environmental Protection Law, have played a great role in the prevention and control of environmental pollution and the improvement of the ecological environment. With the progress of social civilization and the improvement of the people's awareness of environmental protection, The concept of hearing has been introduced into the law for the first time, and the hearing procedure has been pioneered in China. Since then, the Environmental Administrative punishment measures promulgated by the Ministry of Environmental Protection is a refinement of the Administrative punishment Law in the field of environmental protection. The administrative punishment procedures of environmental protection departments have been standardized and the work of environmental law enforcement has been promoted. However, the provisions on hearing in the Administrative punishment Law and the measures for Environmental Administrative punishment are too rough and lack detailed supporting provisions. With the increase of environmental law enforcement and the promotion of public legal awareness, the number of cases applying the hearing procedure is also increasing year by year. In 2010, the Ministry of Environmental Protection formulated and issued the regulations of hearing procedure for Environmental Administrative punishment to refine the hearing regulations and strengthen the operability. The "regulations on hearing procedures for Environmental Administrative punishment" promulgated by the Ministry of Environmental Protection further refine the hearing procedures for environmental administrative penalties, as well as the principles, scope, applicable conditions and proposals for the hearings in the environmental administrative hearing procedures. The contents of the hearing are specified in detail, and the legitimate rights and interests of the parties are prominently safeguarded, the scope of application of the hearing procedure is refined, and the content of the hearing moderator is clarified. This makes the hearing procedure more operable. Although the promulgation of the "rules on hearing procedure for Environmental Administrative punishment" highlights its own advantages and progress, there are still some problems, such as the imperfections of the provisions of the presiding officer of the hearing, and the simple provisions of the relevant contents of the record of the hearing. The material security system of the hearing procedure is insufficient and the problems of non-government environmental protection organizations participating in the hearing are not emphasized. After all, the research on the hearing procedure of environmental administrative punishment is a relatively new topic. In view of these problems, We should perfect the provisions of the presiding officer of the hearing, and put forward corresponding countermeasures in view of the problems in the record of the hearing, and support the material protection of the hearing of environmental administrative punishment through the establishment of special funds. Enhance the role of non-governmental environmental protection organizations in the hearing. As the state attaches importance to the cause of environmental protection, especially since the 18 Party Congress and the third Plenary session of the 18 CPC Central Committee, the state has put the construction of ecological civilization in a prominent position and integrated it into economic construction. Political construction, cultural construction, social construction, all aspects and the whole process, the construction of ecological civilization has entered the overall situation of national economic and social development. The hearing of environmental administrative punishment is an important part of environmental protection and public affairs. It has also been promoted across the country.
