<正>一、前言眾所周知,由于"蒙特勒準(zhǔn)則"¹（Montreux Formula）,1982年《聯(lián)合國(guó)海洋法公約》（United Nations Convention on the Law of the Sea,以下簡(jiǎn)稱"《公約》"）第287條允許締約國(guó)從四個(gè)爭(zhēng)端解決法院或法庭中選擇,以處理與本國(guó)相關(guān)的涉及重要國(guó)際條約解釋與適用的爭(zhēng)端。這四個(gè)爭(zhēng)端解決法院或法庭分別是:國(guó)際海洋法法庭（International Tribunal for the Law of the Sea,以下簡(jiǎn)稱"ITLOS"）、國(guó)際法院（International Court of Justice,以下簡(jiǎn)稱"ICJ"）、《公約》附件七規(guī)定的仲裁程序（附件七仲裁庭）和《公約》附件八規(guī)定的特別仲裁程序（附件八特別仲裁庭）。
