隨著全球化進(jìn)程的深入,我國(guó)與國(guó)際社會(huì)的法律交流不斷增加。就知識(shí)產(chǎn)權(quán)保護(hù)而言,各國(guó)保護(hù)知識(shí)產(chǎn)權(quán)的呼聲日益高漲。多邊貿(mào)易往來(lái)導(dǎo)致的跨國(guó)知識(shí)產(chǎn)權(quán)糾紛的案例也比比皆是。因此,如何有效地促進(jìn)知識(shí)產(chǎn)權(quán)相關(guān)法律的交流變得尤為重要。翻譯轉(zhuǎn)移是翻譯活動(dòng)中常見(jiàn)的一種現(xiàn)象。目前國(guó)內(nèi)對(duì)翻譯轉(zhuǎn)移的研究主要集中在理論研究和文學(xué)翻譯中,對(duì)判決書中的翻譯轉(zhuǎn)移研究較少。本文嘗試將翻譯轉(zhuǎn)移和判決書結(jié)合起來(lái),在信息橋模型的指導(dǎo)下,旨在探討知識(shí)產(chǎn)權(quán)類判決書中的翻譯轉(zhuǎn)移現(xiàn)象。為此,本文提出了三個(gè)研究問(wèn)題:1.在知識(shí)產(chǎn)權(quán)類判決書英譯之中,翻譯轉(zhuǎn)移的具體表現(xiàn)形式有哪些?2.這些翻譯轉(zhuǎn)移的產(chǎn)生受到哪些因素的影響?3.怎樣去評(píng)判這些翻譯轉(zhuǎn)移是否合適?本文選取了6篇知識(shí)產(chǎn)權(quán)類判決書及其英譯本作為語(yǔ)料,結(jié)合法律語(yǔ)篇信息分析,對(duì)其進(jìn)行信息成分的標(biāo)注,比較原文和譯文信息成分的差別。本文從宏觀語(yǔ)言和微觀信息層面總結(jié)了知識(shí)產(chǎn)權(quán)類判決書漢譯英時(shí)發(fā)生的翻譯轉(zhuǎn)移,研究發(fā)現(xiàn)翻譯轉(zhuǎn)移在信息層面主要表現(xiàn)為:信息減少、信息增加、信息更換、信息移位。在語(yǔ)言層面體現(xiàn)在詞匯、句法和語(yǔ)篇方面。在信息橋理論的指導(dǎo)下,本文指出影響翻譯轉(zhuǎn)移的因素主要是社會(huì)文化中的意識(shí)形態(tài),...
