隨著經(jīng)濟(jì)全球化進(jìn)程的日益發(fā)展,中國(guó)與其他國(guó)家的交流更加頻繁與深入。經(jīng)濟(jì)與貿(mào)易的國(guó)際化使得國(guó)家間對(duì)法律翻譯的需求日趨迫切。目前中國(guó)的法律翻譯水平尚未令人滿意,有待進(jìn)一步提高。多數(shù)國(guó)家的法律體系是幾個(gè)世紀(jì)以來(lái)文化和道德發(fā)展的產(chǎn)物。在此背景下,法律譯者不僅必須協(xié)調(diào)語(yǔ)言和文化之間的差異,并且還要在不同法律傳統(tǒng)之間架起橋梁。憲法作為國(guó)家的根本法,為其它法律奠定基礎(chǔ),因而它的翻譯準(zhǔn)確度不僅直接影響影響其法律效力,而且也為其它法律的翻譯提供借鑒。關(guān)聯(lián)理論應(yīng)用于翻譯領(lǐng)域已久,也有學(xué)者將該理論應(yīng)用于法律翻譯領(lǐng)域,力圖將部分不同法律體系的法律概念實(shí)現(xiàn)最大程度貼近原文的翻譯。關(guān)聯(lián)理論最初是語(yǔ)義學(xué)中的一個(gè)理論,其中最為重要的概念,如最佳關(guān)聯(lián)、語(yǔ)境效果與處理努力等已應(yīng)用于翻譯領(lǐng)域,被理解為英譯本讀者與英譯文之間的一種文本“交流”。本文立足關(guān)聯(lián)理論及關(guān)聯(lián)翻譯理論,試圖在理論框架內(nèi),從詞匯、句子結(jié)構(gòu)以及文化差異等方面對(duì)《中華人民共和國(guó)憲法》的英譯本進(jìn)行比較全面地分析,發(fā)現(xiàn)現(xiàn)有憲法英譯本的可取與不足之處,以此為其它法律翻譯提供有利的借鑒,避免因翻譯而產(chǎn)生的歧義與誤解,促進(jìn)中國(guó)法律在其它國(guó)家的影響力。
