【摘要】：本文是一篇翻譯報(bào)告,翻譯原文為安東尼·麥克勞德·肯尼迪大法官(Anthony Mc Leod Kennedy)所撰寫的《美國聯(lián)邦最高法院就霍爾(Hall)訴佛羅里達(dá)州案判決書》。此判決書所闡述的是有關(guān)死刑的重要判決,通過閱讀此判決書,讀者可以領(lǐng)略肯尼迪大法官的判決邏輯和美國的憲法精神。本翻譯報(bào)告首先介紹了原文及其作者的背景,強(qiáng)調(diào)了對美國法院判決書進(jìn)行漢譯的實(shí)際意義,并闡述了譯者在翻譯質(zhì)量控制方面所使用的辦法。立足于目的論,本翻譯報(bào)告進(jìn)一步討論了譯者的職責(zé)和原文作者的意圖,總結(jié)了司法判決書作為一種法律文書所具有的語言特點(diǎn),并由此確立了在對此類文本進(jìn)行翻譯的過程中應(yīng)當(dāng)采取的翻譯策略。針對翻譯過程中遇到的難點(diǎn),譯者通過案例分析的方法,總結(jié)了在此次翻譯實(shí)踐中常用的翻譯方法以及目的論的指導(dǎo)意義。
[Abstract]:This is a translation report for the translation of the original justice Anthony MacLeod Kennedy (Anthony Mc Leod Kennedy) wrote "the Supreme Court of the United States Holzer (Hall) v. Florida verdict verdict. This is an important decision about the death penalty, by reading this verdict, readers can appreciate the spirit of the decision logic justice Kennedy and the constitution of the United States. This report first introduces the source text and the author's background, emphasizes the practical significance of the United States court verdict translation, and expounds the use of translators in terms of translation quality control methods. Based on the skopos theory, the translation of the report further discusses the intention of the translator's responsibilities and the author, summed up the language features of judicial verdict as a legal document has, and thus established in the translation of such texts In the process of translation, translation strategies should be adopted. In view of the difficulties encountered in the translation process, the translator summarizes the common translation methods and the guiding significance of Skopos Theory in the translation practice.
