【摘要】：新疆是一個多民族聚居、多宗教并存的邊疆地區(qū),并且信仰伊斯蘭教的群眾眾多,宗教與政治、文化、社會等方方面面息息相關,宗教問題處理得當與否直接影響著新疆社會的穩(wěn)定與長治久安�！耙婪ㄖ谓�、長期建疆、團結(jié)穩(wěn)疆”,實現(xiàn)新疆社會的穩(wěn)定與長治久安是當前和今后新疆工作的重要內(nèi)容,“遏制宗教極端勢力的蔓延”是當前和今后新疆社會穩(wěn)定和長治久安的重點。因此,必須在依法治國、依法治疆的背景下,用法治思維和法治方式來處理宗教問題,努力做好宗教工作。依法治教,建立社會主義宗教法治體系,用法律規(guī)范宗教事務管理者管理宗教事務的行為,用法律規(guī)范宗教活動,用法律調(diào)節(jié)各種社會關系,用法律保障信教群眾的合法權益,促進新疆宗教和諧、社會穩(wěn)定和長治久安的大局。根據(jù)目前對宗教事務管理法治化的相關研究,筆者基于長治久安的視角,結(jié)合新疆依法治理宗教的實際情況,主要從四個部分展開相關研究:第一部分從研究背景入手,總體上介紹了本文的研究目的與意義、文獻綜述及相關概念的界定與相關理論的簡述;第二部分從新疆地區(qū)宗教分布情況、新疆地區(qū)宗教事務管理法治化的進程以及依法治教在新疆長治久安總目標中的地位三方面,簡明闡述了新疆地區(qū)依法治教的基本概況。第三部分是實證部分,借助“習近平總書記治疆方略與新疆長治久安”課題組的問卷與訪談調(diào)查結(jié)果,筆者獲取了長治久安視角下新疆地區(qū)宗教治理的相關資料,并且深入探究了新疆依法治理宗教的現(xiàn)狀及面臨的主要問題,在調(diào)查研究的基礎上從四個方面進行原因分析。第四部分基于長治久安的視角,根據(jù)當前存在的一些問題,分別從健全宗教法治體系、依法治理非法宗教活動以及提高公民法治意識三方面提出一些對策和建議。最后,結(jié)論部分主要對全文的核心部分進行總結(jié)以及對新疆依法治理宗教工作進行展望。
[Abstract]:Xinjiang is a borderland inhabited by many nationalities and religions, and there are many people who believe in Islam. Religion is closely related to all aspects of politics, culture, society, etc. The proper handling of religious issues directly affects the social stability and stability of Xinjiang. "ruling Xinjiang according to law, building Xinjiang over a long period of time, uniting and stabilizing Xinjiang," and achieving social stability and long-term stability in Xinjiang are important contents of current and future work in Xinjiang. "curbing the spread of religious extremist forces" is the focus of social stability and long-term stability in Xinjiang. Therefore, under the background of ruling the country by law and ruling Xinjiang according to law, we must deal with religious problems with the thinking of rule by law and the way of rule by law, and strive to do a good job in religious work. To administer religion according to law, to establish a socialist system of religious rule by law, to regulate the behavior of religious affairs managers by law, to regulate religious activities by law, to regulate all kinds of social relations by law, and to protect the legitimate rights and interests of religious believers by law. Promote Xinjiang religious harmony, social stability and long-term stability of the overall situation. According to the current research on the rule of law in the management of religious affairs, the author based on the perspective of long-term stability, combined with the actual situation of governing religion according to law in Xinjiang, mainly from four parts of the relevant research: the first part from the research background, The purpose and significance of the research, the definition of literature review, the definition of related concepts and the brief introduction of related theories are introduced in general. The second part is about the distribution of religion in Xinjiang. In this paper, the process of rule by law of religious affairs management in Xinjiang area and the status of managing education according to law in the overall goal of long-term stability in Xinjiang are briefly expounded. The basic situation of managing education according to law in Xinjiang area is briefly expounded. The third part is the empirical part, with the help of the questionnaire and interview results of "General Secretary Xi Jinping's strategy of ruling Xinjiang and lasting peace in Xinjiang", the author obtains the relevant data of religious governance in Xinjiang from the perspective of long-lasting peace. Furthermore, this paper probes deeply into the present situation and main problems of ruling religion according to law in Xinjiang, and analyzes the causes from four aspects on the basis of investigation and research. The fourth part puts forward some countermeasures and suggestions from three aspects: perfecting the system of religious rule of law, administering illegal religious activities according to law and raising citizens' consciousness of ruling by law. Finally, the conclusion part summarizes the core part of the paper and looks forward to the work of governing religion according to law in Xinjiang.
