【摘要】：以往對秦漢時期官吏連坐的研究多從歷史學(xué)的角度展開,且分類標(biāo)準(zhǔn)模糊不清。從任用和管理的角度來看,秦漢官吏連坐現(xiàn)象可分為保舉連坐和行政連帶責(zé)任兩大類,其中后者在基層手工業(yè)、軍事事務(wù)以及官府財物的校驗管理等不同職務(wù)領(lǐng)域規(guī)定不同。保舉連坐和行政連帶責(zé)任是秦漢時期重要的官吏管理制度,并且不斷地成熟和完善,主要表現(xiàn)為整體刑罰的減輕和具體規(guī)則的細(xì)化。
[Abstract]:In the past, the researches on the officials sitting in the Qin and Han dynasties were carried out from the perspective of history, and the classification criteria were vague. From the point of view of appointment and management, the phenomenon of officials' even sitting in Qin and Han dynasties can be divided into two categories: one is to protect and hold office and the other is administrative joint and several liability, and the latter has different regulations in different duty fields, such as the basic level handicraft industry, military affairs and the check and management of government property and so on. As an important administrative system in the Qin and Han dynasties, the administrative joint and several liability system is matured and perfected, which is mainly reflected in the reduction of the overall penalty and the refinement of the specific rules.
