【摘要】：本文是研究12-16世紀英國農(nóng)民土地權(quán)利的一篇文章。中世紀至近代早期英國農(nóng)民的土地權(quán)利演變的過程,可以說是農(nóng)民對土地占有強度的不斷加深,產(chǎn)權(quán)逐漸明晰化的一個過程,并最終實現(xiàn)了對土地的個人財產(chǎn)權(quán)。 全文分為三部分：第一部分為緒論,主要闡述論文選題的來源,總結(jié)國內(nèi)外學者對該選題的研究狀況,并闡明本文要研究的問題與研究方法。第二部分是論文的主體部分,一共三章,其中第一章論述出租制形式在盎格魯-撒克遜時期的英國就已經(jīng)出現(xiàn)了,由于黑死病和土地市場的影響和領(lǐng)主的自營地大量出租,租賃持有者的人數(shù)得到了大量增加,同時,隨著自由持有地、慣例持有地和公簿持有地向租賃持有地的轉(zhuǎn)變以及自由持有地和慣例持有地的轉(zhuǎn)租,到了1600年,自營地、自由持有地和慣例持有地都已大量出租,租賃持有者已經(jīng)具有一定的規(guī)模。第二章論述了英國租賃持有者的人數(shù)和種類,并從經(jīng)濟和法律的角度考察了12-16世紀間,租賃持有者對土地的占有強度在不斷地加深。第三章論述租賃持有者的出現(xiàn)及其發(fā)展,對英格蘭的經(jīng)濟社會產(chǎn)生了很大的影響,它改變了英格蘭鄉(xiāng)村的經(jīng)營模式,農(nóng)民需要作出許多改變來適應這些新變化；非農(nóng)民承租者更容易獲得技術(shù)上的革新；有著商業(yè)背景的承租者通過農(nóng)產(chǎn)品的貿(mào)易而帶來了資本主義式的生產(chǎn)方式。租賃持有者的出現(xiàn)是租地農(nóng)場主出現(xiàn)的重要原因,13、14世紀的租地農(nóng)場主就是當時的租賃持有者,到16世紀,租地農(nóng)場發(fā)生了變化,那些持有大面積土地的人成為了新時代的租地農(nóng)場主。第三部分是結(jié)論,對英國12-16世紀的租賃持有者進行總體的論述。
[Abstract]:This is an article on the 12-16 century British farmers' land rights. During the Middle Ages to the early modern British farmers' land rights evolution, can be said to be the farmers of land possession strength continues to deepen, a process of gradually clear property rights, and eventually realize the land private property right.
This paper is divided into three parts: the first part is the introduction, mainly expounds the origin of the topic and summarizes the domestic and foreign scholars on the research status of the topic, and expounds the problems and research methods of this paper. The lease holders appear is an important reason for the farmer to appear, 13,14 century farmer was the lease holders, to sixteenth Century.
