【摘要】: 全球化與人口遷移互為動(dòng)力。全球化發(fā)展推動(dòng)了人口的跨國(guó)流動(dòng),但與此同時(shí),人類(lèi)跨國(guó)遷移的自由卻受到日益完善的政策法規(guī)制約,由此,也導(dǎo)致了非法移民問(wèn)題的出現(xiàn)。 歐共體/歐盟作為當(dāng)今世界區(qū)域一體化的典范,一方面要推動(dòng)與區(qū)域外國(guó)家進(jìn)行自由交往的外部全球化,另一方面又要在區(qū)域內(nèi)部實(shí)現(xiàn)各要素自由流動(dòng)的內(nèi)部全球化。歐洲一體化進(jìn)程推動(dòng)了歐共體/歐盟社會(huì)的發(fā)展與進(jìn)步,其中移民也起了重要的作用。但隨著一體化進(jìn)程的發(fā)展以及國(guó)內(nèi)外各種因素的影響,歐洲主要國(guó)家逐步由自由放任的移民政策轉(zhuǎn)向積極主動(dòng)的限制性移民政策。合法的移民渠道被收緊,許多移民只能通過(guò)非正當(dāng)途徑進(jìn)入或滯留。隨著非法移民群體的積累壯大,他們給歐洲各國(guó)的政治、經(jīng)濟(jì)、文化、安全等方面帶來(lái)了一系列問(wèn)題,成為近年來(lái)歐盟社會(huì)上下關(guān)注的核心事務(wù)之一。 本文試從治理的視角出發(fā),結(jié)合相關(guān)國(guó)際關(guān)系學(xué)、民族學(xué)、社會(huì)學(xué)、歷史學(xué)等理論,通過(guò)治理的理論框架,分析了歐共體/歐盟各主體對(duì)非法移民的治理問(wèn)題,以期歸納總結(jié)出一些治理的經(jīng)驗(yàn)不足和發(fā)展規(guī)律。歐洲一體化的歷史也被認(rèn)為是歐共體/歐盟治理的歷史。治理是各行為體對(duì)共同利益問(wèn)題進(jìn)行管理的過(guò)程。歐共體/歐盟在其一體化過(guò)程中逐步形成了自身的治理模式。在這一過(guò)程中,傳統(tǒng)的國(guó)家治理主權(quán)不斷地向上、下讓渡,逐步形成了國(guó)家治理、超國(guó)家治理和次國(guó)家治理并存的歐盟多層治理模式。與此同時(shí),治理的范圍也不斷拓展,由單一的經(jīng)濟(jì)治理擴(kuò)大至當(dāng)前的涵蓋經(jīng)濟(jì)與政治、安全與外交、司法與內(nèi)務(wù)等內(nèi)容的三大支柱。非法移民問(wèn)題一開(kāi)始主要產(chǎn)生于各成員國(guó)層面,隨著一體化進(jìn)程的發(fā)展,90年代開(kāi)始成為歐盟的共同關(guān)注的問(wèn)題。歐盟的非法移民治理也同樣在歐盟多層治理體系下于國(guó)家、超國(guó)家、次國(guó)家等層面分別展開(kāi)。基于當(dāng)前的國(guó)際社會(huì)現(xiàn)實(shí),歐盟各成員國(guó)依然是最重要的治理主體,但已經(jīng)難以單獨(dú)完成非法移民治理,超國(guó)家治理的作用日益凸顯,次國(guó)家治理則是有益的補(bǔ)充。歐盟非法移民治理面臨著諸多挑戰(zhàn),其本身也是一個(gè)善治的發(fā)展過(guò)程,克服這些困難需要區(qū)域內(nèi)各主體共同去協(xié)調(diào)努力。
[Abstract]:Globalization and population migration are mutual driving forces. Globalization promotes the transnational movement of population, but at the same time, the freedom of human transnational migration is restricted by the increasingly perfect policies and regulations, which also leads to the emergence of illegal immigration. As a model of regional integration in the world today, the EC / EU should, on the one hand, promote the external globalization of free communication with foreign countries in the region. On the other hand, it is necessary to realize the internal globalization of the free flow of elements within the region. The process of European integration has promoted the development and progress of the EC / EU society, Immigration also played an important role, but with the development of integration process and the influence of various factors at home and abroad, Major European countries have gradually shifted from laissez-faire immigration policies to proactive and restrictive immigration policies. Legal migration channels have been tightened, and many migrants can only enter or remain through irregular channels. They have brought a series of problems to the political, economic, cultural and security aspects of European countries, and have become one of the core concerns of the European Union in recent years. In this paper, from the perspective of governance, combined with the relevant theories of international relations, ethnology, sociology, history and so on, through the theoretical framework of governance, this paper analyzes the governance of various subjects of EC / EU to illegal immigration. The history of European integration is also considered to be the history of EC / EU governance. Governance is the process of various actors' management of common interests. In the process of integration, the Community / EU has gradually developed its own governance model. The traditional state governance sovereignty has been continuously transferred up and down, gradually forming a multi-layer European Union governance model in which state governance, supranational governance and sub-state governance coexist. At the same time, the scope of governance has been continuously expanded. From a single economic governance to the current three pillars covering economic and political, security and foreign affairs, justice and internal affairs. With the development of integration process, in the 1990s, it has become a common concern of the European Union. The European Union's illegal immigration governance is also under the multi-level governance system of the European Union in the national, supranational, Based on the current reality of the international community, EU member States are still the most important governing bodies, but it is already difficult to complete the governance of illegal immigrants alone. The role of supranational governance is becoming increasingly prominent. Sub-state governance is a useful supplement. The EU illegal immigration management faces many challenges, which is also a development process of good governance. To overcome these difficulties, all the main bodies in the region need to work together to coordinate their efforts.
