【摘要】：建設(shè)海外利益保護機制已成為國家戰(zhàn)略。從事這項工作應(yīng)區(qū)分海外利益在境外公民安全保護和新型國家利益建構(gòu)兩個語境下的不同內(nèi)涵,認識到海外利益的地域、物質(zhì)和復合主體屬性。全球化和國民跨境遷移打破了傳統(tǒng)國家自主、自助、自足的形態(tài),國籍國安保資源用于境外利益時不僅效用降低,而且和東道國存在管轄權(quán)沖突。國籍國在海外利益保護中面臨著效用困境、合作困境和法理困境。為此,海外利益保護的機制設(shè)計需發(fā)揮制度在配置資源、界定權(quán)責、承載價值上的作用,堅持有效性、公平性和合法性原則,整合國籍國與東道國、境外國民三方主體的資源優(yōu)勢,顧及東道國的受益度和機會成本,創(chuàng)造性地遵守國際法原則,協(xié)調(diào)國家間的正義觀差異,并確保保護措施在國際社會中的正外部效應(yīng)。
[Abstract]:The construction of the protection mechanism for overseas interests has become a national strategy. This work should distinguish the different connotations of overseas interests in the two contexts of foreign citizens' safety protection and the construction of new national interests, and recognize the regional, material and complex subject attributes of overseas interests. Globalization and the Cross-border Migration of the people have broken the traditional national autonomy and self-help. In the form of self-sufficiency, national security resources are not only reduced in utility in foreign interests, but also in conflict with the jurisdiction of the host country. The state of nationality faces the difficulties of utility, cooperation and jurisprudence in the protection of overseas interests. Therefore, the mechanism design of overseas interests protection needs to play the system in the allocation of resources, to define the power and responsibility and to carry the value. The role of it is to adhere to the principles of validity, fairness and legitimacy, to integrate the resource advantages of the three parties of the state of nationality and the host country, the host country, to take into account the benefit and opportunity cost of the host country, to creatively abide by the principles of international law, to coordinate the differences in the concept of justice among countries, and to ensure the positive external effects of protection measures in the international community.
