【摘要】：“非制度化生存”是日益“市場(chǎng)化社會(huì)”的一個(gè)突出現(xiàn)象。從歸根結(jié)底的意義上說(shuō),日益市場(chǎng)化社會(huì)中屢屢發(fā)生的個(gè)體、組織甚或政府行為中的“去倫理化”“非道德化生存”現(xiàn)象,其實(shí)都與社會(huì)缺乏一種系統(tǒng)性的、在理論上圓融、實(shí)踐中可行的“誠(chéng)信制度文化”和“誠(chéng)信制度價(jià)值”理念設(shè)計(jì)與方略有關(guān)。在這個(gè)意義上,“誠(chéng)信制度化”的根本要義之一,就是“用優(yōu)良制度(規(guī)范的力量)來(lái)約束、解決失信行為”,相信企業(yè)、政府以及個(gè)人,在日常的經(jīng)濟(jì)行為、政治行為和日常生活行為中,只要按照法律法規(guī)行事,按照優(yōu)良道德規(guī)范行事,就絕不會(huì)有失信行為的發(fā)生。不僅如此,誠(chéng)信制度化還有一重重要意涵:用于規(guī)約失信行為的制度本身,一定是最為優(yōu)良,代表了最高的誠(chéng)信規(guī)范價(jià)值,具有其應(yīng)有的約束力。二者的合力,才是現(xiàn)代公序良俗社會(huì)制度誠(chéng)信實(shí)踐的合理的價(jià)值目標(biāo)和應(yīng)有的努力方向。
[Abstract]:Non-institutionalized existence is a prominent phenomenon in the market-oriented society. In the final analysis, the phenomenon of "deethicalization" and "non-moralized existence" in the increasingly market-oriented society, such as individual, organization or even government behavior, is in fact lacking in a systematic and theoretical harmony with society. The practical design of "honesty system culture" and "honesty system value" is related to the general plan. In this sense, one of the fundamental essentials of "institutionalizing good faith" is to "use good institutions (normative forces) to restrain and solve breach of trust," believing that enterprises, governments and individuals are engaged in daily economic behavior. In political behavior and daily life, as long as we act according to laws and regulations, and act in accordance with good ethics, there will never be any breach of faith. Not only that, there is also an important meaning in the institutionalization of good faith: the system itself, which is used to regulate the breach of trust, must be the best, representing the highest standard value of good faith and having its due binding force. The resultant force of the two is the reasonable value goal and due direction of the practice of honesty and credit in modern public order and good custom social system.
