【摘要】：中國—東盟框架內(nèi)的糾紛解決機(jī)制雖然已經(jīng)初步建立,但是難以有效解決現(xiàn)有的"綠色壁壘"問題,主要原因在于"綠色壁壘"本身具有一定合理性,且解決糾紛機(jī)制具有受經(jīng)濟(jì)發(fā)展不平衡影響、政治訴求等內(nèi)生性的困境。要解決中國—東盟自由貿(mào)易區(qū)的"綠色壁壘"問題,必須結(jié)合"綠色壁壘"的兩面性,尋求環(huán)境保護(hù)的對話與合作,構(gòu)建環(huán)境質(zhì)量體系、環(huán)境標(biāo)志互認(rèn)機(jī)制和環(huán)境壁壘預(yù)警機(jī)制。
[Abstract]:Although the dispute resolution mechanism within the framework of China-ASEAN has been initially established, it is difficult to effectively solve the existing "green barrier" problem. The main reason lies in the rationality of "green barrier" itself. Moreover, the dispute resolution mechanism is affected by the imbalance of economic development and political demands. To solve the problem of "green barrier" in China-ASEAN Free Trade area, it is necessary to combine the dual character of "Green Barrier". To seek dialogue and cooperation on environmental protection, to construct environmental quality system, mutual recognition mechanism of environmental markers and early warning mechanism of environmental barriers.
