【摘要】:五千多年歷史的中華文化是世界文化史中的寶貴財(cái)富,其形式之豐富,內(nèi)容之廣博,意蘊(yùn)之深遠(yuǎn),已經(jīng)成為中華兒女砥礪前行的精神動力。文化的發(fā)展與社會生產(chǎn)力的進(jìn)步息息相關(guān),越是往前,越能看到文化與普通百姓生活緊密結(jié)合的影子。文化是反映人們心理變遷的一個(gè)鏡像,人們從愚昧無知逐漸走向文明開化的歷史,正是文化形成、積淀和發(fā)展的過程,也是文化自身價(jià)值累積的過程。許多文化的傳承和發(fā)展都是一種自下而上的結(jié)果,意味著由普通百姓創(chuàng)造的民間文化成為推動歷史進(jìn)步的一種重要力量。民間文學(xué)藝術(shù)正是在這樣的過程中實(shí)現(xiàn)自我更新、自我突破,逐漸形成完整的淘汰和進(jìn)步的機(jī)制。盤古開天地、女媧補(bǔ)天、嫦娥奔月等民間神話承載著中華民族求知求新的精神品質(zhì),部落圖騰、鄉(xiāng)音民謠幻化成維系氏族群體關(guān)系的精神紐帶,浩如煙海的民間文學(xué)作品、舞蹈、手工藝技術(shù)無一不展現(xiàn)了我國民間勞動人民的大智慧。然而,民間文學(xué)藝術(shù)的發(fā)展并非一帆風(fēng)順,經(jīng)過了千百年的洗禮,許多民間文學(xué)藝術(shù)早已湮沒在歷史長河當(dāng)中,僅僅通過古籍或傳說呈現(xiàn)在今人眼中。文化消失從某種角度來講是一種正,F(xiàn)象,猶如身體正常的新陳代謝,但值得警惕的是,是否存在超越這一自身凈化功能的外來因素而可能導(dǎo)致這種文化消失現(xiàn)象的加速。在今天,由于政治、經(jīng)濟(jì)、文化觀念及科技等各方面迅速發(fā)展,民間文學(xué)藝術(shù)正常的生長機(jī)制遭到一定程度的破壞,保護(hù)不及時(shí)、過度商業(yè)化等已經(jīng)對現(xiàn)有的民間文學(xué)藝術(shù)形成威脅和沖擊,使其面臨嚴(yán)峻的保護(hù)形勢。 對民間文學(xué)藝術(shù)的保護(hù)不僅關(guān)系著我國歷史文化傳統(tǒng)的延續(xù),更是我國在經(jīng)濟(jì)全球化時(shí)代應(yīng)對國外文化霸權(quán)主義的必然要求。民間文學(xué)藝術(shù)本身所體現(xiàn)出來的重要性要求我們必須更加深入地認(rèn)識其本質(zhì)和發(fā)展規(guī)律,在此基礎(chǔ)上完善相關(guān)機(jī)制,發(fā)揮法律的作用,促進(jìn)其科學(xué)發(fā)展。本文通過對民間文學(xué)藝術(shù)的基礎(chǔ)理論,民間文學(xué)藝術(shù)的基本屬性,世界各國對民間文學(xué)藝術(shù)保護(hù)模式的選擇進(jìn)行探討和研究,分析我國現(xiàn)在的民間文學(xué)藝術(shù)知識產(chǎn)權(quán)保護(hù)模式是否有效以及我國應(yīng)當(dāng)如何結(jié)合我國實(shí)際國情來展開民間文學(xué)藝術(shù)的保護(hù)工作,并提出相應(yīng)的對策以期為我國民間文學(xué)藝術(shù)保護(hù)工作能夠取得有效進(jìn)展提供一定的參考。
[Abstract]:The Chinese culture with a history of more than five thousand years is a precious wealth in the history of world culture. Its rich form, extensive content and profound implication have become the spiritual motive force for the Chinese people to forge ahead.The development of culture is closely related to the progress of social productive forces.Culture is a mirror image reflecting people's psychological changes, and people's history from ignorance to civilization is the process of culture formation, accumulation and development, as well as the accumulation of culture's own value.The inheritance and development of many cultures is a bottom-up result, which means that the folk culture created by ordinary people has become an important force to promote the progress of history.Folklore is in this process to achieve self-renewal, self-breakthrough, gradually formed a complete mechanism of elimination and progress.The folk myths such as Pangu opening heaven and earth, Nu WA filling the sky, Chang'e running to the moon carry the spiritual quality of the Chinese nation's quest for knowledge and novelty, the tribal totem, and the folk ballads of the local sound, which become the spiritual ties that maintain the relationship between the clan groups, and the vast folklore works of folklore.Dance, handicraft techniques all show the great wisdom of the Chinese folk laboring people.However, the development of folk literature and art is not smooth, after thousands of years of baptism, many folk literature and art has long been lost in the history, only through ancient books or legends to present in the eyes of modern people.The disappearance of culture is a normal phenomenon from a certain point of view, just like the normal metabolism of the body, but it is worthy of caution whether there are external factors beyond this self-purification function which may lead to the acceleration of this phenomenon.Today, due to the rapid development of politics, economy, cultural concepts and science and technology, the normal growth mechanism of folklore and art has been destroyed to a certain extent, and protection is not timely.Excessive commercialization has threatened and impacted the existing folk literature and art, which makes it face a severe protection situation.The protection of folk literature and art is not only related to the continuation of China's historical and cultural traditions, but also to the inevitable requirements of foreign cultural hegemonism in the era of economic globalization.The importance of folklore itself requires us to have a deeper understanding of its essence and law of development, on the basis of which we should perfect the relevant mechanism, give play to the role of law and promote its scientific development.Through the basic theory of folk literature and art, the basic attribute of folk literature and art, and the choice of protection mode of folk literature and art in various countries of the world, this paper discusses and studies the basic theory of folk literature and art, the basic attribute of folk literature and art,This paper analyzes whether the current intellectual property protection mode of folklore in China is effective and how we should combine the actual situation of our country to carry out the protection of folklore.The corresponding countermeasures are put forward in order to provide some references for the effective progress of the protection of folk literature and art in our country.
