【摘要】：從2002年到現(xiàn)在的十年間,我國政府推動的網(wǎng)絡實名制從局部走向全面。推行網(wǎng)絡實名制的正當性和合法性是什么?網(wǎng)絡實名制會對公民網(wǎng)絡表達自由產生怎樣的影響?網(wǎng)絡匿名表達是不是公民的基本權利?如何看待和處理網(wǎng)絡匿名表達與實名制的關系?本文以我國最新推出的網(wǎng)絡實名制相關立法為主要分析對象,探討實名制作為政府對互聯(lián)網(wǎng)信息傳播規(guī)制與網(wǎng)絡匿名表達的沖突與平衡問題,以期對我國互聯(lián)網(wǎng)管理制度的法治建設提供參考。
[Abstract]:In the ten years from 2002 to now, the real name system promoted by our government has changed from partial to comprehensive. What is the legitimacy and legitimacy of carrying out the network real name system? What kind of influence will the network real name system have on the freedom of expression on the network of citizens? Is online anonymous expression a citizen's basic right? How to treat and deal with the relationship between network anonymous expression and real name system? In this paper, the author takes the new legislation of Internet real name system as the main analysis object, and probes into the conflict and balance between the real name system as the government's regulation of Internet information dissemination and the network anonymous expression. In order to provide a reference for the construction of the rule of law in China's Internet management system.
