【摘要】：當(dāng)前,針對(duì)開放式創(chuàng)新平臺(tái)的研究主要集中在市場(chǎng)戰(zhàn)略和模型構(gòu)建等領(lǐng)域,但很少從知識(shí)產(chǎn)權(quán)角度研究平臺(tái)中合作研發(fā)產(chǎn)生的共同發(fā)明的權(quán)利歸屬、分配和行使等問題。事實(shí)上,解決好平臺(tái)中知識(shí)產(chǎn)權(quán)(專利和商業(yè)秘密等)共有問題,將直接決定平臺(tái)用戶間開放式創(chuàng)新的最終成效,從而影響整個(gè)平臺(tái)的運(yùn)營(yíng)。以提升共同發(fā)明的法律確定性與透明度為評(píng)判標(biāo)準(zhǔn),現(xiàn)階段國內(nèi)外相關(guān)立法(包括國際條約)都存在一定缺陷,必要時(shí)須在知識(shí)產(chǎn)權(quán)法和合同之間作出選擇。因此,在"大眾創(chuàng)業(yè)、萬眾創(chuàng)新"背景下,在平臺(tái)用戶、平臺(tái)商和政府多方合作下綜合規(guī)制共同發(fā)明,也許是一條出路。
[Abstract]:At present, the research on open innovation platform mainly focuses on the market strategy and model building, but rarely studies the ownership of co-invention from the perspective of intellectual property. In fact, solving the common problems of intellectual property rights (patents, trade secrets, etc.) in the platform will directly determine the ultimate effectiveness of open innovation among platform users. Thus affecting the operation of the whole platform. To improve the legal certainty and transparency of common inventions as the criterion, at present, the relevant legislation at home and abroad (including international treaties) has some defects. When necessary, the choice must be made between intellectual property law and contract. Therefore, in the context of "mass entrepreneurship, mass innovation", and in the multi-cooperation of platform users, platform vendors and governments, it may be a way out.
