【摘要】：農(nóng)村宅基地是農(nóng)村土地中的重要部分,是農(nóng)民基于居住的目的,申請(qǐng)建造住宅而使用的集體土地,農(nóng)民享有使用權(quán)。一方面,我國(guó)法律限制了宅基地使用權(quán)的流轉(zhuǎn),引起了宅基地大量閑置、“空心村”現(xiàn)象等問(wèn)題;另一方面,城鎮(zhèn)化進(jìn)程對(duì)土地資源的需求日益增長(zhǎng)。為了集約利用土地,優(yōu)化資源配置,我們國(guó)家從2004年的《國(guó)發(fā)[2004]28號(hào)》文件開(kāi)始到2017年的中央一號(hào)文件,期間頒布了多項(xiàng)關(guān)于宅基地制度改革等一系列政策文件,來(lái)加強(qiáng)農(nóng)村宅基地使用權(quán)的合法流轉(zhuǎn),并在中央政策的指導(dǎo)下,各地都在積極探索有效的宅基地使用權(quán)流轉(zhuǎn)試點(diǎn)。本文通過(guò)總結(jié)現(xiàn)有宅基地使用權(quán)流轉(zhuǎn)試點(diǎn)模式,按照流轉(zhuǎn)價(jià)格制定的主體對(duì)其分類,分為政府主導(dǎo)型、市場(chǎng)主導(dǎo)型、農(nóng)民集體主導(dǎo)型三種流轉(zhuǎn)模式,結(jié)合制度變遷理論對(duì)各模式的制度變遷動(dòng)因和制度供給主體進(jìn)行比較分析,得出政府主導(dǎo)型和市場(chǎng)主導(dǎo)型流轉(zhuǎn)模式的制度變遷路徑是強(qiáng)制性制度變遷路徑,農(nóng)民集體主導(dǎo)型流轉(zhuǎn)模式是誘致性制度變遷路徑的結(jié)論,并結(jié)合流轉(zhuǎn)試點(diǎn)案例對(duì)三種模式的運(yùn)行機(jī)制、成本分擔(dān)和收益分配進(jìn)行比較,從制度環(huán)境、制度內(nèi)容以及制度效率進(jìn)行總結(jié),從不同的角度考慮,不同的流轉(zhuǎn)模式各有利弊,因此在當(dāng)前的國(guó)情背景下,應(yīng)因地制宜的并審慎穩(wěn)妥的進(jìn)行宅基地使用權(quán)流轉(zhuǎn)試點(diǎn),并通過(guò)相關(guān)政策將各種流轉(zhuǎn)模式進(jìn)行完善,確保農(nóng)民利益,從而促進(jìn)宅基地使用權(quán)的流轉(zhuǎn)。
[Abstract]:The rural homestead is an important part of the rural land. It is the collective land used by the peasants for the purpose of living, and the peasants have the right to use it.On the one hand, the law of our country has restricted the circulation of the right to use the homestead, which has caused a large number of idle homestead, "hollow village" and other problems; on the other hand, the demand for land resources in the process of urbanization is increasing day by day.In order to make intensive use of land and optimize the allocation of resources, our country began from the document "Guofa [2004] 28" in 2004 to the first document of the Central Committee in 2017, during which a number of policy documents on the reform of the homestead system were promulgated.To strengthen the legal circulation of rural homestead use right, and under the guidance of central policy, all localities are actively exploring effective homestead use right transfer pilot.This paper summarizes the existing land use right transfer pilot model, according to the circulation price of the main body of the classification, divided into government-led, market-oriented, farmers collective dominated three circulation models,Combining with the theory of institutional change, this paper makes a comparative analysis of the drivers of institutional change and the main body of institutional supply of each mode, and concludes that the path of institutional change of government-led and market-oriented circulation mode is compulsory institutional vicissitude.The farmer collective dominant circulation mode is the conclusion that induces the institutional change path, and unifies the circulation pilot case to carry on the comparison to the three modes' operation mechanism, the cost sharing and the income distribution, from the system environment,The content of the system and the efficiency of the system are summarized. Considering from different angles, different circulation modes have their own advantages and disadvantages. Therefore, under the background of the current national conditions, we should carry out pilot projects of the circulation of the right to use the homestead in accordance with local conditions and prudently and steadily.And through the relevant policies to improve the circulation model, to ensure the interests of farmers, thereby promoting the circulation of homestead use rights.
