【摘要】：我國目前關(guān)于公用事業(yè)的界定以物業(yè)小區(qū)規(guī)劃紅線為界,規(guī)劃紅線以外的部分屬于城市基礎(chǔ)設(shè)施,建設(shè)經(jīng)費由財政負(fù)擔(dān);規(guī)劃紅線以內(nèi)的部分則屬于業(yè)主共有,建設(shè)經(jīng)費自籌,管理和維護(hù)費用自己負(fù)擔(dān)。在公用事業(yè)公司化改革中,政府通過特許經(jīng)營合同授權(quán)專業(yè)經(jīng)營單位提供具有經(jīng)營性或可以市場化的商品或服務(wù),但具有公益性的基礎(chǔ)設(shè)施的供給義務(wù)不能移轉(zhuǎn)。物業(yè)小區(qū)基礎(chǔ)設(shè)施是公眾社會權(quán)實現(xiàn)的物質(zhì)基礎(chǔ),屬于公共服務(wù)范疇,其建設(shè)費應(yīng)當(dāng)統(tǒng)一納入城市基礎(chǔ)設(shè)施配套費,與城市基礎(chǔ)設(shè)施相銜接,政府是產(chǎn)權(quán)人,是管理與維護(hù)的最終責(zé)任承擔(dān)者。經(jīng)營單位與用戶僅為民事契約關(guān)系,政府公共服務(wù)應(yīng)到達(dá)具體用戶,由此,建立"統(tǒng)一規(guī)劃、統(tǒng)一設(shè)計、統(tǒng)籌收費、統(tǒng)一管理"的公用事業(yè)經(jīng)營、管理體系。
[Abstract]:At present, the definition of public utilities in our country is defined by the red line of property plot planning. The part other than the red line of planning belongs to the urban infrastructure, and the construction expenses are borne by the financial; the parts within the planning red line are owned by the owners and the construction funds are self-financed. Manage and maintain the expenses at your own expense. In the reform of public utility corporatization, the government authorizes the professional management unit to provide the goods or services which have the operation or can be marketized through the franchise contract, but the supply obligation of the public welfare infrastructure can not be transferred. Real estate infrastructure is the material basis for the realization of public social rights, and belongs to the category of public services. The construction expenses should be unified into the supporting fees of urban infrastructure, which should be linked to the urban infrastructure. The government is the owner of property rights. Is the ultimate responsibility for management and maintenance. The management unit and the user are only civil contract relations, the government public service should reach the concrete user, therefore, establishes the "unified plan, the unified design, the overall plan, the unified management" public utility management, the management system.
