【摘要】：財權作為足球協(xié)會自治的一項基本權力有著明確的國家法律和行業(yè)規(guī)范依據,本文著重對中英足球協(xié)會的財權進行了比較,針對性提出了中國足協(xié)財權改革的建議。研究認為:國家法律賦予足球協(xié)會獨立的"社團法人"身份,規(guī)定了財產權的性質、宗旨及權能,而行業(yè)規(guī)范進一步細化了財權內容,提供了協(xié)會運行的主要依據。足球協(xié)會財權具有自治特征,需要建立均衡的財權制度,將多方主體納入到行業(yè)利益秩序的"共建"中。英格蘭足協(xié)與英超聯(lián)盟采取"財權分置",分別享有足總杯、慈善盾杯和英超聯(lián)賽的所有權。英足協(xié)財權集中,實行財務管理和經營分離,依托專業(yè)團隊建立起了完善的市場運營體系,財權配置能力突出。中國足協(xié)的自主財權缺失,財權關系較為復雜,所建構的市場運營體系矛盾突出,亟需系統(tǒng)優(yōu)化。在國家足球戰(zhàn)略布局中,應建立職業(yè)聯(lián)賽利益共享制度,推動中國足協(xié)財權合理配置,優(yōu)化經營及利益分配制度,切實提高管理能力。
[Abstract]:As a basic right of football association autonomy, the financial right has clear national laws and trade norms. This paper makes a comparison of the financial rights of the Chinese and English football associations, and puts forward some suggestions for the reform of the financial rights of the Chinese football association. The study holds that: the national law gives the football association an independent "association legal person" status, which stipulates the nature, purpose and power of the property right, while the industry norm further refines the content of the financial right and provides the main basis for the operation of the association. The financial rights of football association have the characteristics of autonomy, so it is necessary to establish a balanced system of financial rights and bring various subjects into the "co-construction" of the order of the interests of the industry. The English Football Association and the Premier League adopt a separate ownership of the FA Cup, the Charity Shield and the Premier League. The financial power of the English Football Association is centralized, the financial management is separated from the management, and a perfect market operation system has been established by relying on the professional team, and the allocation ability of the financial power is outstanding. Because of the lack of independent financial rights and the complex relationship between financial power and financial power, the market operation system constructed by the Chinese Football Association is in serious contradiction and needs to be optimized in a systematic way. In the strategic layout of national football, we should establish the system of benefit sharing in the professional league, promote the rational allocation of the financial power of the Chinese Football Association, optimize the system of management and benefit distribution, and improve the management ability.
