【摘要】："普萊西訴弗格森案"是美國聯(lián)邦最高法院關(guān)于種族隔離問題的一次重要判決。通過對(duì)雙方律師的辯論、最高法院多數(shù)意見與反對(duì)意見爭論的梳理,較為完整地呈現(xiàn)案件的訴訟過程和結(jié)果。案件中"隔離但平等"的判決雖然確立了種族隔離的合憲性,但其實(shí)質(zhì)是對(duì)"平等"的強(qiáng)調(diào),是在最高司法層面肯定了種族之間的平等地位。在當(dāng)時(shí)歷史條件下,種族隔離的學(xué)校教育符合黑人教育發(fā)展的客觀需要,某種程度上對(duì)黑人教育的發(fā)展起到了積極促進(jìn)作用。從法理意義上講,種族隔離并不一定意味著種族歧視,種族融合也并不一定代表種族平等。
[Abstract]:Plessy v. Ferguson is an important U.S. Supreme Court ruling on apartheid. Through the argument of the lawyers of both sides, the dispute between the majority opinion and the dissenting opinion of the Supreme Court, the litigation process and the result of the case are presented completely. Although the decision of "segregation but equality" in the case established the constitutionality of apartheid, its essence is to emphasize "equality" and affirm the equality between races at the highest judicial level. Under the historical conditions at that time, the segregated school education met the objective needs of the development of black education, and to some extent played an active role in promoting the development of black education. In the legal sense, apartheid does not necessarily mean racial discrimination, nor does racial integration necessarily mean racial equality.
