【摘要】：這是一個權(quán)利的時代。權(quán)利語言與權(quán)利設(shè)制對于一個常態(tài)社會越來越起到結(jié)構(gòu)性和決定性作用。教師法的頒行是對教師政治地位與法律地位的雙重確認,是對教師權(quán)益的法制化保障,具有重大進步意義。但在教育法治遲滯發(fā)展的大背景下,立法技術(shù)與法精神的積淀不足,教師法在教師專業(yè)權(quán)利義務(wù)上不夠明晰,對作為影響教師發(fā)展的重要因素的行政主管部門的權(quán)力缺少規(guī)制,體現(xiàn)出較為明顯的國家權(quán)力本位,減損了教師法為教師專業(yè)發(fā)展賦權(quán)增能之功效,影響到教師普遍而基本的專業(yè)發(fā)展的權(quán)利。
[Abstract]:This is an era of rights.The language of rights and the establishment of rights play a more and more structural and decisive role in a normal society.The enactment of the teacher's Law is a dual confirmation of the teacher's political and legal status and a legal guarantee of the teacher's rights and interests, which is of great progressive significance.However, under the background of the lagging development of educational rule by law, the accumulation of legislative techniques and legal spirit is insufficient, the teacher's law is not clear enough in teachers' professional rights and obligations, and the power of administrative departments, which is an important factor affecting teachers' development, is not regulated.It reflects the more obvious state power standard, detracts from the effect of teachers' law to empower teachers' professional development, and affects teachers' general and basic rights of professional development.
