【摘要】：目前,學(xué)界有學(xué)者用"第三波"理論對廣東等地探索村民自治新形式的實踐進(jìn)行了富有啟發(fā)性的理論解釋,但這種解釋與實踐探索之間還存在一定的距離,不夠全面和深入。本文在重新檢討民主與治理割裂論、國家與社會脫節(jié)論、體制與制度緊張論等已有理論解釋的基礎(chǔ)上,重構(gòu)解釋村民自治陷入困境的新框架——"五權(quán)"結(jié)構(gòu)平衡論,以此作為分析廣東等地探索村民自治新形式的理論起點。基于廣東探索村民自治新形式所形成的"一核主導(dǎo)、雙重服務(wù)""政經(jīng)分離""三元制衡""四權(quán)同步"等實踐經(jīng)驗,對廣東等地村民自治的新形式給予的理論定位是:從形式上看這種探索是尋求"五權(quán)"結(jié)構(gòu)的動態(tài)平衡,就其實質(zhì)而言是把村民自治有機(jī)整合到以黨政體制為基礎(chǔ)的國家治理體系中,以實現(xiàn)"三元統(tǒng)一",即將政黨執(zhí)政的權(quán)威性、國家治理的有效性、村民自治的參與性有機(jī)統(tǒng)一于中國共產(chǎn)黨在鄉(xiāng)村執(zhí)政的合法性。尋求"三元統(tǒng)一"對村民自治的現(xiàn)實成長具有重要意義。
[Abstract]:At present, some scholars have used the "third wave" theory to explain the practice of exploring the new form of villagers' autonomy in Guangdong and other places, but there is still a certain distance between this interpretation and practical exploration, which is not comprehensive and deep enough. On the basis of reviewing the theory of separation between democracy and governance, the theory of disconnection between state and society, and the theory of system and system tension, this paper reconstructs a new frame to explain the dilemma of villager autonomy, namely the "five powers" structural balance theory. This is the theoretical starting point of exploring new forms of villager autonomy in Guangdong and other places. Based on the practical experience of "one nuclear leading, double service", "separation of politics and economy," ternary checks and balances, "synchronization of four powers" formed by Guangdong Province in exploring new forms of villager autonomy, The theoretical orientation given to the new form of villagers' autonomy in Guangdong and other places is: from a formal point of view, this exploration is to seek the dynamic balance of the "five powers" structure. In essence, it is to integrate villager autonomy into the national governance system based on the party and government system, so as to realize the "ternary unity", that is, the authority of the ruling party and the effectiveness of the governance of the country. The participative organic unity of villager autonomy lies in the legitimacy of the Communist Party of China (CPC) ruling in the countryside. It is of great significance to seek ternary unity for the practical growth of villager autonomy.
