新疆公募基金會發(fā)展狀況研究

【摘要】:2016年《慈善法》頒布實施,使得基金會再一次成為人們關(guān)注的焦點。這對于新疆公募基金會來說,既是一個機遇也是一個挑戰(zhàn)。經(jīng)過二十多年的發(fā)展,新疆公募基金會已經(jīng)達到24家,截至2014年底,新疆公募基金會總資產(chǎn)達到14840.05萬元,在婦女、兒童、殘疾人、教育、醫(yī)療等領(lǐng)域開展了一系列活動,為維護新疆社會穩(wěn)定和長治久安做出了巨大貢獻。但是,在發(fā)展過程中仍存在比較多的問題,發(fā)展空間還很大。筆者先是從基本概況和發(fā)展現(xiàn)狀兩個方面描述了新疆公募基金會的特點、產(chǎn)權(quán)特征、歷史發(fā)展、法律制度框架、數(shù)量及規(guī)模、收入結(jié)構(gòu)、活動領(lǐng)域、人力資源、治理現(xiàn)狀等。發(fā)現(xiàn)新疆公募基金會多為政府推動生成,目前規(guī)模較小,集中分布在省會城市,只有3家位于其他地(州、市),資助方向偏好于教育等傳統(tǒng)領(lǐng)域,運作模式以項目運作為主。由此可以看出新疆公募基金會的發(fā)展具有政府主導(dǎo)推動成立運行、數(shù)量及資產(chǎn)規(guī)模不大、地域發(fā)展相對集中、以項目運作型為主等特點。本文結(jié)合筆者在新疆婦女兒童發(fā)展基金會、新疆維吾爾自治區(qū)殘疾人福利基金會和新疆維吾爾自治區(qū)青少年發(fā)展基金會的訪談結(jié)果,運用資源依賴理論,從法律制度、資金募集力度、活動領(lǐng)域、職業(yè)化和專業(yè)化建設(shè)、內(nèi)部治理等方面分析了新疆公募基金會發(fā)展面臨的問題,并探究了問題產(chǎn)生的原因。由于新疆公募基金會還處在發(fā)展的初級階段,一些問題在所難免,問題的解決也不是一蹴而就,新疆公募基金會的健康發(fā)展需要政府多個部門以及社會各個領(lǐng)域的大力推動。為了有效解決新疆公募基金會發(fā)展中遇到的突出問題,作者在理論指導(dǎo)下提出了具有針對性的對策建議,如通過完善相關(guān)法律法規(guī)突破制度障礙;調(diào)整基金會運作模式,使其從項目運作型轉(zhuǎn)變?yōu)楣尜Y助型,提高基金會的資金管理能力;通過建立行業(yè)服務(wù)機構(gòu),促進內(nèi)部分工協(xié)作等方式,克服新疆公募基金會在發(fā)展中遇到的困難,而且這些對策對于新疆公募基金會健康良性發(fā)展有一定的借鑒意義。
[Abstract]:In 2016, the charity law was promulgated and implemented, which once again made the foundation a focus of attention. This is an opportunity and a challenge for the Xinjiang Public offering Foundation. After more than 20 years of development, As of end of 2014, the total assets of Xinjiang Public offering Foundation have reached one hundred and forty-eight million four hundred thousand and five hundred yuan. A series of activities have been carried out in the fields of women, children, disabled people, education, medical treatment, etc. Great contributions have been made to maintaining social stability and lasting stability in Xinjiang. However, there are still many problems in the process of development. The author first describes the characteristics, property rights, historical development, legal system framework, quantity and scale, income structure, activity field of Xinjiang Public offering Foundation from two aspects: basic situation and current situation. Human resources, the current situation of governance, etc. It is found that most of the public offering foundations in Xinjiang are generated by the government. At present, they are relatively small and are concentrated in provincial capitals. Only three are located in other places (state, city, etc.), and the direction of funding prefers traditional fields such as education. From this, we can see that the development of Xinjiang Public offering Foundation has the government to lead the establishment of the operation, the number and asset scale is small, and the regional development is relatively concentrated. This paper combines the interview results of the author in the Xinjiang Women and Children Development Foundation, the Xinjiang Uygur Autonomous region Disability Welfare Foundation and the Xinjiang Uygur Autonomous region Youth Development Fund. Based on the theory of resource dependence, this paper analyzes the problems facing the development of Xinjiang Public offering Foundation from the aspects of legal system, fund raising, activity field, professionalization and specialization construction, internal governance, etc. As the Xinjiang Public offering Foundation is still in the initial stage of development, some problems are inevitable, and the solution of the problem will not be achieved overnight. The healthy development of the Xinjiang Public Endowment Foundation needs to be vigorously promoted by many government departments and various fields of society. In order to effectively solve the outstanding problems encountered in the development of the Xinjiang Public Endowment Foundation, Under the guidance of the theory, the author puts forward some countermeasures and suggestions, such as breaking through the institutional barriers by perfecting the relevant laws and regulations, adjusting the operation mode of the foundation, and changing the operation model of the foundation from the project operation type to the public welfare subsidization type. To improve the fund management ability of the foundation; to overcome the difficulties encountered in the development of the Xinjiang Public offering Foundation through the establishment of industry service organizations and the promotion of internal division of labor and cooperation. Moreover, these countermeasures have certain reference significance for the healthy development of Xinjiang Public offering Foundation.
