【摘要】：福建平潭綜合實驗區(qū)是海峽經(jīng)濟區(qū)的核心,對深化海峽兩岸交流合作、擴大國家對外開放具有重要的戰(zhàn)略意義。隨著平潭綜合實驗區(qū)建設(shè)的開展,平潭在經(jīng)濟、社會、行政管理等方面進行了體制機制改革創(chuàng)新,在一些重點領(lǐng)域和關(guān)鍵環(huán)節(jié)實行先行先試,爭取率先取得突破.平潭港區(qū)作為平潭綜合實驗區(qū)開發(fā)建設(shè)的重要依托,海峽西岸經(jīng)濟區(qū)對臺“三通”的主通道、主樞紐、主要口岸之一,是海峽兩岸合作交流先行先試的重要平臺,也在飛速發(fā)展。作為港區(qū)監(jiān)管服務(wù)的重要成員,平潭海事必須適應(yīng)當(dāng)?shù)厣鐣l(fā)展的需要,改進現(xiàn)有執(zhí)法模式,才能適應(yīng)社會發(fā)展的需要,為當(dāng)?shù)亟?jīng)濟發(fā)展保駕護航.本文主要的目的也是主要探討在當(dāng)?shù)厣鐣w速發(fā)展的大環(huán)境下,平潭海事如何切實發(fā)揮海事職能,認真做好服務(wù),實施有效監(jiān)管。 本文首先利用運用公共管理、公共行政學(xué)和新公共服務(wù)的相關(guān)理論,對服務(wù)型海事的概念進行了解釋和界定,明確了本文海事行政執(zhí)法的具體內(nèi)容。其次通過對平潭現(xiàn)有通航環(huán)境與平潭海事執(zhí)法現(xiàn)狀的實際調(diào)研,了解了實施海事有效執(zhí)法面臨的困難以及造成海事執(zhí)法困境的原因;同時結(jié)合平潭綜合實驗區(qū)的總體規(guī)劃和平潭港區(qū)規(guī)劃,探討了平潭海事的執(zhí)法前景與自身的海事服務(wù)定位.另外還對對美國、日本、韓國、澳大利亞等國的海上執(zhí)法形式與國內(nèi)部分海事機構(gòu)的先進執(zhí)法形式進行了分析,找出了平潭海事可以借鑒之處。 最后,結(jié)合平潭海事的現(xiàn)有實際與發(fā)展前景,本文對如何完善平潭服務(wù)型海事執(zhí)法提出了具體的意見和建議。
[Abstract]:Fujian Pingtan Comprehensive Experimental Zone is the core of the Taiwan Straits Economic Zone, which is of great strategic significance for deepening cross-strait exchanges and cooperation and expanding the opening-up of the country to the outside world. With the development of the construction of Pingtan Comprehensive Experimental area, Pingtan has reformed and innovated the system and mechanism in the aspects of economy, society, administration and so on. It has tried first in some key fields and key links in order to make a breakthrough in the first place. Pingtan Port area, as an important support for the development and construction of Pingtan Comprehensive Experimental Zone, is the main channel, main hub and one of the main ports of the "three links" to Taiwan in the West Coast Economic Zone of the Straits, and is an important platform for cross-strait cooperation and exchange first and first. It is also developing at full speed. As an important member of supervision and service in Hong Kong, Pingtan maritime affairs must adapt to the needs of local social development and improve the existing law enforcement mode in order to adapt to the needs of social development and protect the local economic development. The main purpose of this paper is also to discuss how to give full play to the maritime function of Pingtan maritime affairs, do a good job of service and carry out effective supervision under the environment of the rapid development of local society. Firstly, using the theories of public administration, public administration and new public service, this paper explains and defines the concept of service-oriented maritime affairs, and clarifies the concrete content of maritime administrative law enforcement in this paper. Secondly, through the actual investigation on the current navigable environment of Pingtan and the current situation of the maritime law enforcement in Pingtan, the difficulties faced in implementing effective maritime law enforcement and the reasons for the difficulties in maritime law enforcement are understood. At the same time, combined with the overall planning of Pingtan Comprehensive Experimental area and Pingtan Port District, this paper discusses the prospect of Pingtan maritime law enforcement and its own maritime service orientation. In addition, the maritime law enforcement forms of the United States, Japan, South Korea, Australia and other countries and the advanced law enforcement forms of some domestic maritime agencies are analyzed, and the reference points for Pingtan Maritime Affairs are found out. Finally, combined with the existing reality and development prospects of Pingtan maritime affairs, this paper puts forward concrete suggestions and suggestions on how to perfect the Pingtan service-oriented maritime law enforcement.
