【摘要】：隨著數(shù)字信息技術的迅速發(fā)展,信息共享的模式越來越趨于多樣化,信息交流的渠道也逐漸增多。開放存取運動和開放數(shù)據(jù)的理念得到了快速的發(fā)展,這些理念和運動,是作為數(shù)字資源開放存取的重要理念。近幾年來,數(shù)字資源開放存取文化理念大量興起,使得數(shù)字資源開放存取發(fā)展的前景一片看好,但是我們仍無法忽視在新環(huán)境下數(shù)字資源開放存取的建設和發(fā)展的道路上存在的一些問題。譬如在現(xiàn)有的著作權法律框架下,如何解決好數(shù)字開放存取涉及的知識產(chǎn)權問題,避免潛在的相關利益方之間的糾紛,是實現(xiàn)數(shù)字資源開放存取最大化自由開放存取和學術自由的重要保證。 數(shù)字資源通過開放存取實現(xiàn)其價值的再利用和增值,其前提條件是要在現(xiàn)行的體系框架下,保障知識產(chǎn)權,實現(xiàn)各方利益的平衡,分析數(shù)字資源開放存取的法律關系,明確界定其法律關系中的主客體及其權利內容,是實現(xiàn)開放存取的高效機制的關鍵。鑒于以上問題,本文以云計算的出現(xiàn)和開放存取運動為背景,從云時代數(shù)字資源開放存取的目的與意義出發(fā),闡述其在運行和發(fā)展過程中涉及到的法律主體和法律客體,相關權利義務關系以及數(shù)字產(chǎn)權問題,并認為在云環(huán)境下,數(shù)據(jù)的價值很大一部分體現(xiàn)在數(shù)據(jù)的再利用的用途上,我們需要更注重于數(shù)據(jù)使用者為其行為承擔責任,而不是將重心放在收集數(shù)據(jù)之初取得個人許可上,提出建立數(shù)字資源開放存取的問責機制,并提出在合理使用和著作權交易市場理論方面的建議,以期合理妥善解決開放存取在新環(huán)境下所涉及的版權問題,規(guī)避著作權風險,促進數(shù)字信息資源的健康快速發(fā)展和自由共享交流。
[Abstract]:With the rapid development of digital information technology, the mode of information sharing is becoming more and more diversified, and the channels of information exchange are gradually increasing. The concept of open access movement and open data has been developed rapidly. These concepts and movements are important concepts of open access to digital resources. In recent years, the concept of open access culture of digital resources has sprung up, which makes the development of open access of digital resources promising. However, we can not ignore some problems in the construction and development of open access to digital resources in the new environment. For example, under the existing copyright legal framework, how to resolve the intellectual property issues involved in digital open access and avoid disputes between potential stakeholders, It is an important guarantee to realize the digital resource open access maximization free open access and academic freedom. In order to realize the reuse and value addition of digital resources through open access, the precondition is to protect intellectual property rights, realize the balance of interests of all parties, and analyze the legal relationship of open access to digital resources under the existing system framework. Clearly defining the subject and object and the content of their rights is the key to realize the efficient mechanism of open access. In view of the above problems, based on the emergence of cloud computing and the movement of open access, starting from the purpose and significance of open access of digital resources in the cloud era, this paper expounds the legal subject and legal object involved in its operation and development. Related rights and obligations, and digital property rights, and think that in the cloud, a large part of the value of data is reflected in the reuse of data, and we need to focus more on the accountability of data users for their actions. Rather than focusing on obtaining individual permits at the beginning of data collection, proposing mechanisms for accountability for open access to digital resources, as well as recommendations on rational use and on the theory of the copyright trading market, The aim is to solve the copyright problems of open access in the new environment, to avoid copyright risks, to promote the healthy and rapid development of digital information resources and free sharing and exchange.
