【摘要】：編輯作為著作權(quán)實(shí)施的重要環(huán)節(jié),在出版事業(yè)中起著重要的作用。雖然出版作品中凝結(jié)了編輯大量且已隱性融入作品的創(chuàng)造性勞動(dòng),但由于現(xiàn)有法律法規(guī)的局限性及編輯自身知識(shí)產(chǎn)權(quán)保護(hù)意識(shí)的不足,導(dǎo)致編輯在工作中產(chǎn)生的知識(shí)產(chǎn)權(quán)保護(hù)困難,甚至被忽視。文章從編輯的工作類別論述了編輯知識(shí)產(chǎn)權(quán)的產(chǎn)生及其類別,分析了關(guān)于編輯知識(shí)產(chǎn)權(quán)問題的怪圈,針對(duì)現(xiàn)有的社會(huì)環(huán)境和法律、法規(guī)體系,提出了利用《商標(biāo)法》《專利法》等現(xiàn)有法律積極捍衛(wèi)編輯知識(shí)產(chǎn)權(quán)的幾點(diǎn)措施,并根據(jù)權(quán)利義務(wù)對(duì)等的法理基本要求,提出在強(qiáng)調(diào)編輯義務(wù)與責(zé)任的同時(shí),應(yīng)確定編輯相應(yīng)的法律權(quán)利;倡導(dǎo)業(yè)界統(tǒng)一思想、積極努力,促進(jìn)相關(guān)法律法規(guī)的進(jìn)一步完善。
[Abstract]:Editor, as an important link of copyright implementation, plays an important role in publishing. Although the published works have condensed a large number of creative work of editors and have been tacitly integrated into the works, but due to the limitations of existing laws and regulations and the lack of intellectual property protection consciousness of the editors themselves, As a result, editors in the work of intellectual property rights protection difficulties, or even ignored. This paper discusses the emergence and category of editor's intellectual property right from the working category of editor, analyzes the strange circle of editing intellectual property right problem, and aims at the existing social environment, law and regulation system. This paper puts forward some measures to actively defend the intellectual property rights of editors by using the existing laws such as the Patent Law and so on, and according to the basic requirements of the legal principle of reciprocity of rights and obligations, it puts forward that the editorial obligations and responsibilities should be emphasized at the same time. We should define the corresponding legal rights of editors, advocate the unified thinking of the industry, make active efforts to promote the further improvement of relevant laws and regulations.
