【摘要】：網(wǎng)絡(luò)改變了人們傳統(tǒng)獲取知識的方式,信息復(fù)制和知識傳播的方式、速度與頻度都與現(xiàn)實空間有所不同。網(wǎng)絡(luò)帶給人們一種前所未有的思維與生活空間,知識財產(chǎn)及其權(quán)益的產(chǎn)生、運用、交易和法律保護(hù)等等方面都是傳統(tǒng)知識產(chǎn)權(quán)法所無法駕馭的。是把既有的知識產(chǎn)權(quán)模式移植到網(wǎng)絡(luò)世界中,還是改革傳統(tǒng)的知識產(chǎn)權(quán)以適應(yīng)新時代的網(wǎng)絡(luò)文化,創(chuàng)造一種多方共贏的文化與技術(shù)生產(chǎn)模式?本文作者通過對國內(nèi)外知識產(chǎn)權(quán)學(xué)者觀點的研究總結(jié),指出網(wǎng)絡(luò)空間與現(xiàn)實空間的不同架構(gòu),網(wǎng)絡(luò)環(huán)境下產(chǎn)生了新形式的知識產(chǎn)品；通過訪談和問卷調(diào)查的社會學(xué)統(tǒng)計方法了解網(wǎng)民對網(wǎng)絡(luò)公共資源開放現(xiàn)狀的看法,總結(jié)出網(wǎng)絡(luò)知識產(chǎn)權(quán)的現(xiàn)狀及存在的問題,根據(jù)互聯(lián)網(wǎng)的性質(zhì)與特點,從公共資源的角度提出作者對網(wǎng)絡(luò)知識產(chǎn)權(quán)的看法,并主張借鑒國外的先進(jìn)經(jīng)驗,創(chuàng)建知識產(chǎn)權(quán)制度的新模式,適當(dāng)?shù)母母铿F(xiàn)有的知識產(chǎn)權(quán)制度。
[Abstract]:The network has changed the traditional way of acquiring knowledge, the way of information replication and knowledge transmission, the speed and frequency are different from the real space. The network brings people a kind of unprecedented thinking and living space, the generation, application, transaction and legal protection of intellectual property and its rights and interests are all beyond the control of traditional intellectual property law. Is it to transplant the existing intellectual property model into the network world or to reform the traditional intellectual property rights to adapt to the new era of network culture to create a win-win culture and technology production mode? Through the research and summary of the intellectual property scholars at home and abroad, the author points out that the different structures of cyberspace and real space produce new forms of knowledge products under the network environment. Through the sociological statistical method of interview and questionnaire survey, the author finds out the Internet users' views on the current situation of the opening up of the network public resources, sums up the current situation and the existing problems of the network intellectual property, and according to the nature and characteristics of the Internet, From the point of view of public resources, the author puts forward the author's views on network intellectual property rights, and advocates to draw lessons from the advanced experience of foreign countries, to establish a new model of intellectual property system, and to reform the existing intellectual property rights system appropriately.
