【摘要】：基于國家對知識產(chǎn)權(quán)的重視,企業(yè)在競爭中對知識產(chǎn)權(quán)保護需求的不斷增加,開展專利預(yù)警工作成為了企業(yè)的重要內(nèi)容。本文首先通過對國內(nèi)外專利計量與專利預(yù)警研究的成果進行綜述,發(fā)現(xiàn)國外在專利計量與預(yù)警方面不論在技術(shù)、方法、前沿應(yīng)用上都高于國內(nèi)發(fā)展水平。國內(nèi)盡管在專利計量與預(yù)警研究重點、研究內(nèi)容上與國外存在差異,但也取得了一定的研究成果。其次,本文對專利計量與預(yù)警相關(guān)概念、專利預(yù)警相關(guān)理論基礎(chǔ)、專利計量方法在預(yù)警中應(yīng)用以及專利預(yù)警的作用作了闡述。然后,構(gòu)建了面向企業(yè)應(yīng)用的專利預(yù)警體系,提出該預(yù)警體系包含專利預(yù)警指標(biāo)的構(gòu)建、專利預(yù)警策略的制定以及專利預(yù)警保障機制建設(shè)等內(nèi)容。本文從與企業(yè)密切相關(guān)的技術(shù)、投入、市場、法律四個維度出發(fā),設(shè)立了20個預(yù)警指標(biāo)。利用專家咨詢法、層次分析法對各項指標(biāo)進行了權(quán)重計算。該20個指標(biāo)是基于現(xiàn)有研究基礎(chǔ),根據(jù)數(shù)據(jù)易獲取性、反映特征明顯性等特點對已有指標(biāo)進行調(diào)整獲得。最后,本文以百度公司為例,利用innography數(shù)據(jù)庫對其專利進行詳細分析、統(tǒng)計,并與谷歌公司進行比較,然后對百度公司的各項專利預(yù)警指標(biāo)進行計算,得到最終的預(yù)警警度值。通過警度值的比較,得出目前百度公司所處的預(yù)警狀態(tài),并給出相應(yīng)的應(yīng)對策略。
[Abstract]:Due to the importance attached by the state to intellectual property rights, the demand for the protection of intellectual property rights of enterprises is increasing in the competition. It has become an important content of enterprises to carry out patent warning work. Firstly, this paper summarizes the research results of patent metrology and patent early warning at home and abroad, and finds out that foreign countries in patent measurement and early warning, whether in technology, method, The frontier application is higher than the domestic development level. Although there are some differences between domestic and foreign countries in patent measurement and early warning research, some research results have been achieved. Secondly, this paper introduces the related concepts of patent measurement and early warning. The theoretical basis of patent early-warning, the application of patent metrology in early warning and the function of patent early-warning are expounded. Then, a patent early-warning system for enterprises is constructed, which includes the construction of patent early-warning index. The establishment of patent early-warning strategy and the construction of patent early-warning mechanism. This paper sets up 20 early-warning indexes from the four dimensions of technology, investment, market and law, which are closely related to enterprises, and makes use of expert consultation method. Analytic hierarchy process (AHP) is used to calculate the weight of each index. The 20 indexes are based on the existing research basis, and are adjusted according to the characteristics of data availability and obvious characteristics. Finally, this paper takes Baidu Company as an example. The patent is analyzed, counted and compared with Google Company by using innography database, and then the final warning alarm value is obtained by calculating the patent warning index of Baidu Company. Get the current warning state of Baidu company, and give the corresponding strategy.
