【摘要】：文章認(rèn)為隨著我國(guó)全面深化改革的不斷推進(jìn),土地承包經(jīng)營(yíng)權(quán)制度在內(nèi)在構(gòu)造上面臨著諸多挑戰(zhàn),需進(jìn)一步予以完善:應(yīng)修正以農(nóng)地具有生存保障功能為內(nèi)核、以農(nóng)業(yè)戶(hù)籍為標(biāo)準(zhǔn)而確立的土地承包資格,使二者之間實(shí)現(xiàn)脫鉤。耕地"30年"承包期限的規(guī)定過(guò)于注重土地承包經(jīng)營(yíng)權(quán)用益物權(quán)屬性的結(jié)果,土地承包制度的"長(zhǎng)久不變"也不意味著土地承包經(jīng)營(yíng)權(quán)成為無(wú)期限物權(quán),未來(lái)立法應(yīng)設(shè)計(jì)土地承包經(jīng)營(yíng)權(quán)期限的彈性化制度。為進(jìn)一步彰顯土地承包經(jīng)營(yíng)權(quán)的私權(quán)屬性,宜確立承包地動(dòng)態(tài)調(diào)整制度,并就調(diào)整方式、調(diào)整時(shí)間等進(jìn)行妥善安排。
[Abstract]:The paper holds that with the continuous progress of deepening the reform in an all-round way, the land contractual management right system is facing many challenges in its internal structure and needs to be further improved: the land contracting qualification established with the survival guarantee function of agricultural land as the core and the agricultural household registration as the standard should be revised so as to realize the decoupling between the two. The stipulation of "30 years" contract term of cultivated land pays too much attention to the result of the attribute of usufruct of land contractual management right, and the "long-term immutability" of land contract management system does not mean that the land contractual management right becomes indefinite real right. In the future legislation should design a flexible system of land contractual management right term. In order to further highlight the private attribute of land contractual management right, it is necessary to establish the dynamic adjustment system of contracted land, and make proper arrangements for the adjustment mode and time.
