【摘要】：源生于政策的農(nóng)民住房財產(chǎn)權(quán)不能在既存的法律體系中找到直接對應(yīng),卻可在其間尋覓相應(yīng)的契合點,即農(nóng)民住房財產(chǎn)權(quán)是由宅基地使用權(quán)和農(nóng)村房屋所有權(quán)有機結(jié)合而成。農(nóng)民住房財產(chǎn)權(quán)的倡設(shè)是為了實現(xiàn)相關(guān)權(quán)利身份性的突破和財產(chǎn)性的彰顯,這種制度調(diào)整有其必要性和可行性,以農(nóng)民住房財產(chǎn)權(quán)統(tǒng)合宅基地使用權(quán)和農(nóng)村房屋所有權(quán),有利于達成制度改革目標(biāo),需要以必要住房財產(chǎn)權(quán)和剩余住房財產(chǎn)權(quán)的區(qū)分為基礎(chǔ)進行制度設(shè)置。
[Abstract]:The farmers' housing property rights, which originated from the policy, can not find a direct correspondence in the existing legal system, but can find the corresponding meeting point during them, that is, the farmers' housing property rights are formed by the organic combination of the right to use the homestead and the ownership of the rural houses. The initiative of farmers' housing property rights is to realize the breakthrough of the identity of related rights and the manifestation of property. It is necessary and feasible to adjust this system. The integration of farmers' housing property rights with the right to use homestead and the ownership of rural houses is conducive to achieving the goal of system reform. It is necessary to set up the system on the basis of the distinction between essential housing property rights and surplus housing property rights.
