論精神障礙者民事權利的保護

【摘要】：隨著我國在2013年5月1日頒布了《精神衛(wèi)生法》,精神障礙者的權利保護問題也越來越受到重視。精神障礙者作為一個特殊的民事主體,不具備完全民事權利能力和民事行為能力,加之人們對精神障礙者的歧視,使其生活狀態(tài)堪憂。隨著我國法制的健全,我國應該對精神障礙者更加的關注與保護。在精神障礙者民事權利的保護中,法律起著至關重要的作用。本文旨在通過對精神障礙者的民事權利及其保護問題的研究,嘗試著構建精神障礙者的權利保護的體制,為我國的法制進步作為理論上的貢獻。本文分為四個部分,具體的內容如下： 第一部分是精神障礙者民事主體地位的概述。主要研究了民事主體的概念、種類與精神障礙者的特殊的民事主體地位。通過研究民事主體的概念,說明精神障礙者是一種特殊的民事主體,為下文研究精神障礙者的民事權利作下鋪墊。 第二部分是精神障礙者的民事權利研究。先是對民事權利的概念和分類進行研究,然后在普通民事權利的基礎上研究精神障礙者特殊的民事權利。精神障礙者作為限制民事行為能力人和無民事行為能力人,他們所享有的民事權利也受到了限制,他們沒有普通的自然人的一些民事權利,但是也享有一些特殊的、需要特別關注的民事權利,如治療康復權、物質幫助權等。 第三部分是研究我國法律中保護精神障礙者民事權利的制度及其缺陷。首先研究了國外和國內保護精神障礙者民事權利的一些法律制度。在這些法律制度中,關于精神障礙者的鑒定制度、成年監(jiān)護制度以及對于精神障礙者的權利救濟制度存在著一定的缺陷為下文的完善這些缺陷提出建議做好鋪墊。 第四部分是關于完善我國保護精神障礙者的民事權利的法律制度的建議。本部分分為三個模塊,分別是完善精神障礙者的鑒定制度、完善成年監(jiān)護制度和完善精神障礙者的權利救濟制度。通過提出筆者自己的建議,為我國保護精神障礙者的民事權利作出一定的貢獻。
[Abstract]:With the promulgation of Mental Health Law on May 1, 2013, more and more attention has been paid to the protection of the rights of people with mental disorders. As a special civil subject, people with mental disorders do not have the capacity of civil rights and civil behavior, coupled with the discrimination of people with mental disorders, which makes their living conditions worrying. With the perfection of our country's legal system, our country should pay more attention and protection to the mentally handicapped. The law plays a vital role in the protection of the civil rights of the mentally handicapped. The purpose of this paper is to study the civil rights and their protection of the mentally handicapped, to try to construct the system of the protection of the rights of the mentally handicapped, and to make a theoretical contribution to the progress of the legal system in our country. This paper is divided into four parts, the specific contents are as follows: the first part is a summary of the civil subject status of mental disorders. This paper mainly studies the concept of civil subject, types and special civil subject status of mental disorders. By studying the concept of civil subject, it is shown that mental disorder is a special civil subject, which paves the way for the following research on the civil rights of mental disorders. The second part is the study of the civil rights of the mentally handicapped. First, the concept and classification of civil rights are studied, and then the special civil rights of mental disorders are studied on the basis of ordinary civil rights. As persons with limited capacity for civil conduct and persons without civil capacity, the civil rights enjoyed by them are also restricted. They do not have some civil rights of ordinary natural persons, but they also enjoy some special ones. Civil rights that require special attention, such as the right to treatment and rehabilitation, the right to material assistance, and so on. The third part is to study the system and defects of protecting the civil rights of mental disorders in Chinese law. First, it studies some legal systems to protect the civil rights of mentally handicapped people both at home and abroad. In these legal systems, there are some defects in the appraisal system, adult guardianship system and the right relief system for mental disorders. The fourth part is about perfecting our country's legal system of protecting the civil rights of the mentally handicapped. This part is divided into three modules: perfect the appraisal system of mental disorders, perfect the adult guardianship system and perfect the right relief system of mental disorders. By putting forward my own suggestions, we can make some contributions to the protection of civil rights of mentally handicapped people in our country.
