【摘要】：自然災(zāi)害行政救助的立法原意是加強(qiáng)政府對行政相對人的生存照顧,白2010年頒布《自然災(zāi)害行政救助條例》以來,我國在自然災(zāi)害行政救助的制度建設(shè)方面已經(jīng)有長足的進(jìn)步,第一次將自然災(zāi)害行政救助提升到行政法規(guī)的地位。這足以看出我國立法對于自然災(zāi)害行政救助的重視。自然災(zāi)害近年來發(fā)生頻繁和造成損失嚴(yán)重,為了維護(hù)社會秩序的穩(wěn)定,我國有必要加強(qiáng)自然災(zāi)害行政救助的立法研究。 本文一共分為三個部分。在本文第一個部分,首先將自然災(zāi)害行政救助定義為：具有法定職責(zé)的行政機(jī)關(guān)和法律、法規(guī)授權(quán)的組織根據(jù)法律、法規(guī)、規(guī)章等的規(guī)定,依照法定程序向遭受自然災(zāi)害導(dǎo)致財產(chǎn)或人身損害而急需救助的行政相對人提供物質(zhì)、金錢和服務(wù)援助的行政活動。其次,從一般法學(xué)原理的角度分析、介紹了我國自然災(zāi)害行政救助的特征和內(nèi)容。本文的第二個部分提出現(xiàn)行自然災(zāi)害行政救助立法中存在的問題：對自然災(zāi)害行政救助授權(quán)性主體規(guī)定不具體；自然災(zāi)害行政救助對象不明確；行政救助的適用條件過高；救助方式不夠明確。本文最后一個部分針對我國自然災(zāi)害行政救助立法存在的問題提出了一些立法建議。如明確授權(quán)性救助主體；明確自然災(zāi)害行政救助對象；降低自然災(zāi)害行政救助的適用條件；明確自然災(zāi)害行政救助的救助方式。
[Abstract]:The legislative intent of administrative relief for natural disasters is to strengthen the government's care for the survival of administrative counterparts. Since the promulgation of the "regulations on Administrative Relief of Natural disasters" in 2010, China has made considerable progress in the construction of administrative relief systems for natural disasters. For the first time, the administrative relief of natural disasters will be promoted to the status of administrative laws and regulations. This is enough to see the importance of our legislation on administrative relief of natural disasters. Natural disasters occur frequently and cause serious losses in recent years. In order to maintain the stability of social order, it is necessary to strengthen the legislative research on administrative relief of natural disasters in China. This paper is divided into three parts. In the first part of this paper, administrative relief for natural disasters is defined as: administrative organs and laws with statutory responsibilities, organizations authorized by laws and regulations, etc., in accordance with the provisions of laws, regulations, rules, etc. The administrative activity of providing material, money, and service assistance to an administrative counterpart who is in urgent need of relief as a result of property or personal injury caused by a natural disaster. Secondly, the characteristics and contents of administrative relief of natural disasters in China are introduced from the point of view of general legal principles. The second part of this paper puts forward the problems existing in the current legislation of administrative relief of natural disasters: the provisions on the authorized subject of administrative relief of natural disasters are not specific; the object of administrative relief of natural disasters is not clear; the applicable conditions of administrative relief are too high; The way of aid is not clear enough. The last part of this paper puts forward some legislative suggestions on the problems existing in the legislation of administrative relief of natural disasters in China. Such as defining the subject of authorized relief; defining the object of administrative relief of natural disasters; reducing the applicable conditions of administrative relief of natural disasters; clarifying the relief methods of administrative relief of natural disasters.
