【摘要】：2008年6月1日實(shí)施的《中華人民共和國(guó)禁毒法》（以下稱《禁毒法》）將公安強(qiáng)制戒毒和司法勞教戒毒兩種模式合二為一，在對(duì)我國(guó)戒毒體制進(jìn)行重構(gòu)的基礎(chǔ)上，首次提出了“強(qiáng)制隔離戒毒”，既推動(dòng)我國(guó)戒毒工作向法制化、規(guī)范化發(fā)展，又彰顯了我國(guó)在戒毒管理體制上注入人文關(guān)懷的決心和精神。 強(qiáng)制隔離戒毒從戒毒人員定位為“違法者、受害者和病人”出發(fā)，彰顯了以人為本的立法精神，突出了教育戒治效果最大化為立法目的。但是，，由于《禁毒法》立法原則過于抽象，特別是對(duì)強(qiáng)制隔離戒毒立法規(guī)制存在體制等方面的諸多缺陷，同時(shí)受我國(guó)以往強(qiáng)制戒毒體制機(jī)制、觀念等根深蒂固的影響，強(qiáng)制隔離戒毒執(zhí)法過程中擺脫不了以前強(qiáng)制戒毒的路徑依賴，導(dǎo)致在運(yùn)行過程禁毒法的精神和宗旨得不到充分體現(xiàn)。 本文以強(qiáng)制隔離戒毒的構(gòu)建為視角，闡述了強(qiáng)制隔離戒毒制度的法律性質(zhì)和特征，辨析這一制度與其他相關(guān)戒毒制度的關(guān)系，總結(jié)出強(qiáng)制隔離戒毒制度的優(yōu)越性和科學(xué)性，通過探究當(dāng)前我國(guó)強(qiáng)制隔離戒毒工作中存在的問題，提出自己對(duì)健全和完善我國(guó)強(qiáng)制隔離戒毒制度的構(gòu)想。
[Abstract]:The Drug Control Law of the people's Republic of China (hereinafter referred to as the Drug Control Law), which was implemented on June 1, 2008, combines the two models of compulsory detoxification by public security and detoxification through re-education through judicial labor, and on the basis of reconstructing the detoxification system in China, "compulsory and isolated detoxification" is proposed for the first time, which not only promotes the legalization and standardization of detoxification in our country, but also demonstrates the determination and spirit of humanistic care injected into the administration system of detoxification in our country. From the orientation of detoxification personnel as "lawbreakers, victims and patients", the compulsory isolation of detoxification shows the spirit of legislation based on people-oriented, and highlights the legislative purpose of maximizing the effect of education, abstinence and treatment. However, due to the fact that the legislative principles of the Drug Control Law are too abstract, especially the defects in the system of compulsory isolation and detoxification, and at the same time, they are deeply influenced by the system mechanism and concept of compulsory detoxification in the past in our country. In the process of enforcement of compulsory drug treatment, it is difficult to get rid of the path dependence of compulsory detoxification, which makes the spirit and purpose of drug control law not fully embodied in the course of operation. From the perspective of the construction of compulsory isolation detoxification, this paper expounds the legal nature and characteristics of compulsory isolation detoxification system, discriminates and analyzes the relationship between this system and other related detoxification systems, and sums up the superiority and scientific nature of compulsory isolation detoxification system. Through probing into the problems existing in the work of compulsory isolation detoxification in our country at present, the author puts forward his own idea of perfecting and perfecting the system of compulsory isolation detoxification in our country.
