【摘要】：時(shí)下,法國正面臨二戰(zhàn)后最嚴(yán)重的恐怖主義威脅。奧朗德總統(tǒng)被迫四度延長全國緊急狀態(tài),朝野共同商討有效的反恐對(duì)策,嘗試建立綜合的反恐體系。"新反恐法"便是這一背景下出臺(tái),目的是"在緊急狀態(tài)下所確立的司法框架之外","持久地強(qiáng)化行政機(jī)構(gòu)及司法機(jī)構(gòu)所可使用的手段與方式"。在內(nèi)容上,"新反恐法"引入了多種反恐偵查及預(yù)防手段,涉及刑法、刑事訴訟、財(cái)政管控等諸多領(lǐng)域,強(qiáng)化了對(duì)恐怖犯罪的刑事打擊,并嘗試從源頭上切斷恐怖活動(dòng)的資金來源。但一套精心設(shè)計(jì)的綜合反恐體系依然面臨諸多挑戰(zhàn),仍有進(jìn)一步完善的空間。
[Abstract]:France is facing its worst terrorist threat since World War II. President Hollande has been forced to extend the state of emergency for four times, to discuss effective counterterrorism measures and to try to establish a comprehensive counter-terrorism system. " The new Anti-Terrorism Act was enacted against this background with the aim of "beyond the judicial framework established in a state of emergency" and "to strengthen permanently the means and means available to the executive and the judiciary". In terms of content, the "New Anti-Terrorism Law" introduces a variety of anti-terrorist investigation and prevention measures, involving criminal law, criminal proceedings, financial control and other fields, and strengthens the criminal crackdown on terrorist crimes. And try to cut off the sources of financing for terrorist activities at the source. But a well-designed comprehensive anti-terrorism system still faces many challenges and there is room for further improvement.
