【摘要】：終身教育自引入我國(guó)以來(lái),從最初的理念演變成一種思潮乃至國(guó)家的政策方針與立法舉措,期間經(jīng)歷了約三十年。一項(xiàng)成熟教育政策的最終歸宿乃是立法,終身教育亦不例外。在普遍推進(jìn)終身教育發(fā)展、構(gòu)建終身教育體系的今天,如何從立法的高度對(duì)終身教育所體現(xiàn)的各項(xiàng)基本原則予以明確與界定,這在當(dāng)前的中國(guó)社會(huì)已經(jīng)成為一項(xiàng)迫在眉睫的重大課題。然而,自2005年中國(guó)大陸首先在地方層面開(kāi)啟終身教育立法以來(lái),雖然福建省、上海市、太原市率先實(shí)現(xiàn)了終身教育立法零的突破,但國(guó)家層面的終身教育法仍如空中樓閣,遲遲沒(méi)有進(jìn)展。其中的緣由究竟何在,又是怎樣的瓶頸與難題制約了國(guó)家終身教育法的制定?本文通過(guò)國(guó)內(nèi)立法背景的梳理、國(guó)際立法理念的追溯與解讀,以及具體立法涉及的重要條款的深入分析,對(duì)正在醞釀?dòng)懻摰膰?guó)家終身教育法的立法思想與法律框架進(jìn)行深入探討,所提觀點(diǎn)可為國(guó)家終身教育法的制定提供參考。
[Abstract]:Since its introduction into China, lifelong education has evolved from an initial concept into a trend of thought and even a national policy, and legislative measures, which have experienced about 30 years. The ultimate destination of a mature education policy is legislation, and lifelong education is no exception. Today, with the development of lifelong education and the construction of lifelong education system, how to define the basic principles embodied in lifelong education from the perspective of legislation, This has become an urgent and important issue in the current Chinese society. However, since 2005, when the Chinese mainland first started the lifelong education legislation at the local level, although Fujian, Shanghai and Taiyuan have taken the lead in achieving a breakthrough in the legislation of lifelong education, the national life-long education law is still like a castle in the air. Progress has been delayed. What is the reason, and what are the bottlenecks and problems that restrict the establishment of the national lifelong education law? This article through the domestic legislative background combing, the international legislation idea traceability and the interpretation, as well as the concrete legislation involves the important clause thorough analysis, This paper probes into the legislative thought and legal framework of the national lifelong education law, which is under discussion, and provides a reference for the formulation of the national lifelong education law.
