非全日制用工的勞動者權(quán)益保護研究

【摘要】:非全日制用工作為一種靈活的就業(yè)方式,如今廣泛存在于第三產(chǎn)業(yè)。它因為用工成本低、工作時間彈性大等特點而備受青睞,不僅滿足了勞動者自主擇業(yè)和靈活就業(yè)的需求,也緩解了勞動力市場供求嚴重失衡的矛盾,成為促進就業(yè)的重要途徑。我國相關(guān)立法過于強調(diào)非全日制用工的靈活性,而忽視其安定性,從而造成了非全日制勞動者的權(quán)益嚴重受損。如何在強調(diào)非全日制用工靈活就業(yè)的同時,保障非全日制用工勞動者的合法權(quán)益,是我國完善立法時必須慎重考慮的問題。 本文除了引言和結(jié)語外,共分為四個部分: 文章第一部分:“非全日制用工的一般理論”,首先從理論及立法層面對非全日制用工之概念進行界定,其次論述了非全日制用工的特殊性,最后闡述了非全日制用工形式對于靈活就業(yè)這一目標的積極意義,即在促進就業(yè)、滿足不同勞動者的擇業(yè)需求上具有較大的作用。 第二部分為“我國非全日制勞動者權(quán)益受侵害的現(xiàn)狀及成因”,探討了我國對非全日制用工在勞動合同、休息休假、報酬等方面的法律規(guī)定與我國非全日制勞動者權(quán)益受損害的現(xiàn)狀,并從理論認識、實際情況以及立法技術(shù)上討論了我國非全日制勞動者權(quán)益受到侵害的原因。其中,我國非全日制勞動者權(quán)益受到損害主要表現(xiàn)為:終止用工沒有任何保護,勞動合同簽訂形式不能達到保障勞動者權(quán)益的目的等等。 第三部分“非全日制用工勞動者權(quán)益保護的域外立法經(jīng)驗及啟示”則深入探討了域外關(guān)于非全日制用工的相關(guān)學(xué)說以及關(guān)于保護非全日制勞動者的立法和措施,并結(jié)合我國立法現(xiàn)狀探討得出域外非全日制用工制度中勞動者權(quán)益保護的啟示,即不僅要重視非全日制用工的發(fā)展,為保護勞動者權(quán)益作出努力,,還應(yīng)當(dāng)使平等保護成為立法基本原則。 在完成了理論鋪墊、境外考察及我國立法檢討的基礎(chǔ)上,第四部分將關(guān)注重點回歸到我國非全日制用工制度的構(gòu)建上。在我國非全日制用工法律路徑的設(shè)計上,樹立妥當(dāng)?shù)膭趧雨P(guān)系認定標準,秉持體面勞動、平等待遇的原則,并針對我國存在的對非全日制勞動者保障不力的問題,在非全日制用工的終止保護、薪酬支付、工作時間等方面提出完善建議。
[Abstract]:As a flexible way of employment, part-time employment now widely exists in the tertiary industry. It is favored because of its low labor cost and large flexibility of working time. It not only meets the needs of workers to choose their own jobs and obtain flexible employment, but also alleviates the contradiction of serious imbalance between supply and demand in the labor market and becomes an important way to promote employment. The relative legislation of our country emphasizes too much the flexibility of part-time employment, but neglects its stability, which results in serious damage to the rights and interests of part-time workers. How to protect the legitimate rights and interests of part-time workers while emphasizing flexible employment of part-time employees is a problem that must be carefully considered when our country consummates legislation. In addition to the introduction and conclusion, this paper is divided into four parts: The first part of the article: "the general theory of part-time employment", firstly defines the concept of part-time employment from the theoretical and legislative levels, and then discusses the particularity of part-time employment. Finally, the positive significance of part-time employment for flexible employment is expounded, that is, it plays a great role in promoting employment and meeting the needs of different workers in choosing a job. The second part is "the present situation and causes of the infringement of the rights and interests of part-time workers in China", and discusses the labor contract, rest and leave of part-time workers in China. This paper discusses the reasons for the infringement of the rights and interests of part-time workers in China from the aspects of theoretical understanding, practical situation and legislative technology. Among them, the damage to the rights and interests of part-time workers in China is mainly manifested in: termination of employment without any protection, labor contract signing form can not achieve the purpose of protecting workers' rights and interests, and so on. The third part, "Extra-territorial legislative experience and enlightenment on the protection of the rights and interests of part-time workers", probes into the relevant theories of part-time employment and the legislation and measures to protect part-time workers. Combined with the current situation of legislation in our country, the enlightenment of the protection of workers' rights and interests in the foreign part-time employment system is obtained, that is, not only should we attach importance to the development of part-time employment, but also make efforts to protect the rights and interests of workers. Equal protection should also be made a fundamental principle of legislation. On the basis of theoretical foundation, overseas investigation and legislative review of our country, the fourth part will focus on returning the focus to the construction of part-time employment system in China. With regard to the design of the legal path of part-time employment in China, we should set up appropriate standards for the determination of labor relations, uphold the principle of decent work and equal treatment, and aim at the problem of inadequate protection for part-time workers in our country. Provide suggestions on termination protection, pay, working hours, etc.
