【摘要】：志愿服務(wù)是基于自由意志而非基于個(gè)人義務(wù)或法律責(zé)任,不以取得報(bào)酬為目的而從事的各項(xiàng)社會公益服務(wù)�，F(xiàn)代志愿服務(wù)的范圍已經(jīng)拓展到了突發(fā)事件應(yīng)急救援領(lǐng)域,即應(yīng)急志愿服務(wù)。應(yīng)急志愿服務(wù)是指志愿者、志愿者組織在公共突發(fā)事件的應(yīng)對中提供、開展的志愿服務(wù)。應(yīng)急志愿服務(wù)在近年來各種重大突發(fā)事件的應(yīng)對過程中發(fā)揮了極為重要的作用,但也暴露出了很多問題,如未被納入各級應(yīng)急管理體系、沒有專門的法律予以保障等。 迄今為止,在志愿服務(wù)立法方面,我國大陸已頒布36部現(xiàn)行有效的地方志愿服務(wù)條例,全國性志愿服務(wù)條例已列入國務(wù)院立法工作計(jì)劃,我國應(yīng)急管理體系建設(shè)也在如火如荼的開展著。在這樣的大背景下,研究應(yīng)急志愿服務(wù),并將之列入全國志愿服務(wù)條例中,無論在現(xiàn)實(shí)層面還是理論層面都很有價(jià)值和意義。 本文主要通過明確應(yīng)急志愿服務(wù)的概念,介紹其他國家和地區(qū)對應(yīng)急志愿服務(wù)的立法經(jīng)驗(yàn),來探析我國應(yīng)該如何抓住制訂國家志愿服務(wù)條例的機(jī)會,建立應(yīng)急志愿服務(wù)的法律保障體系。除緒論和結(jié)語外,文章分三個(gè)部分展開論述： 第一部分為第二章,在分析突發(fā)事件、志愿服務(wù)概念的基礎(chǔ)上,引出應(yīng)急志愿服務(wù)的概念,繼而分析了應(yīng)急志愿服務(wù)與常態(tài)志愿服務(wù)的不同之處,最后介紹了國內(nèi)外應(yīng)急志愿服務(wù)的發(fā)展歷程。 第二部分為第三章,選取英美法系的美國、大陸法系的德國以及與我國大陸文化同源的臺灣地區(qū)為代表,介紹了境外應(yīng)急志愿服務(wù)的立法現(xiàn)狀,并從中總結(jié)能為我國大陸所借鑒的經(jīng)驗(yàn)。 第三部分為第四章,立足于我國現(xiàn)有的地方志愿服務(wù)條例,分析其立法成果與不足之處,提出在起草的全國志愿服務(wù)條例中,設(shè)立“應(yīng)急志愿服務(wù)”專章,規(guī)定應(yīng)急志愿服務(wù)的特殊活動原則、協(xié)調(diào)機(jī)制以及其他相關(guān)內(nèi)容,以期對我國應(yīng)急志愿服務(wù)法律體系的建立起到一定的促進(jìn)作用。
[Abstract]:Voluntary service is a kind of social public service based on free will, not individual obligation or legal responsibility. The scope of modern volunteerism has been extended to the emergency rescue field, that is, emergency volunteer service. Emergency volunteer service refers to volunteers, volunteer organizations in the response to public emergencies to provide, carry out voluntary services. Emergency volunteerism has played a very important role in the response to various major emergencies in recent years, but also exposed many problems, such as not being included in the emergency management system at all levels, no special laws to protect and so on. So far, in the area of voluntary service legislation, the mainland of China has promulgated 36 existing local voluntary service regulations, and the national voluntary service regulations have been included in the legislative work plan of the State Council. China's emergency management system is also in full swing. Under this background, it is of great value and significance to study emergency volunteer service and to include it in the national voluntary service regulations, both in practical and theoretical aspects. In this paper, by clarifying the concept of emergency volunteerism and introducing the legislative experience of other countries and regions on emergency volunteerism, this paper explores how to seize the opportunity to formulate national voluntary service regulations in China. Establish a legal protection system for emergency voluntary service. In addition to the introduction and conclusion, the article is divided into three parts: The first part is the second chapter. On the basis of analyzing the concept of emergency and volunteer service, the paper introduces the concept of emergency volunteer service, and then analyzes the difference between emergency volunteer service and normal voluntary service. Finally, the development of emergency voluntary service at home and abroad is introduced. The second part is the third chapter, including the United States of America, Germany of civil law and Taiwan with the same cultural origin in mainland China, and introduces the current situation of emergency voluntary service legislation abroad. And summarize the experience that can be used for reference by the mainland of China. The third part is the fourth chapter, based on the existing local voluntary service regulations, analyzes its legislative achievements and deficiencies, proposed in the draft of the national voluntary service regulations, the establishment of "emergency volunteerism" chapter. The special activity principle, coordination mechanism and other related contents of emergency voluntary service should be stipulated in order to promote the establishment of the legal system of emergency voluntary service in China.
