【摘要】：高校是一個匯集了大量的知識和研發(fā)人才的地方,是高校職務發(fā)明人進行發(fā)明創(chuàng)造的主要根據(jù)地,也是推進我國科技創(chuàng)新、產(chǎn)出科技成果的重要場所。自從我國實施創(chuàng)新型國家發(fā)展戰(zhàn)略之后,我國立法者也逐步修訂了相關法律來推動科技創(chuàng)新。政府也響應國家的號召,陸續(xù)出臺了一系列政策來鼓勵和支持高�？萍汲晒难邪l(fā)。在國家和政府一系列的激勵措施下,我國高校發(fā)明成果的數(shù)量也出現(xiàn)爆發(fā)式增長。但是相比之下,發(fā)明成果的市場化環(huán)節(jié)進度卻異常緩慢。因此,本文擬就促進高校職務發(fā)明轉(zhuǎn)化率的提高,完善高校職務發(fā)明轉(zhuǎn)化機制的問題做一探討。要解決問題,首先要找準原因。制約高校職務發(fā)明轉(zhuǎn)化因素不僅包括高校和職務發(fā)明人的研發(fā)和轉(zhuǎn)化熱情不高還包括科技成果轉(zhuǎn)化平臺不健全、轉(zhuǎn)化模式不成熟等。但是筆者認為其中高校和其發(fā)明人研發(fā)和轉(zhuǎn)化熱情不高是高校職務發(fā)明轉(zhuǎn)化率低的根本原因。因此,筆者把激發(fā)高校和職務發(fā)明人的創(chuàng)造和轉(zhuǎn)化熱情作為研究的出發(fā)點和價值取向,進而提出了完善高校職務發(fā)明轉(zhuǎn)化機制的一系列相關建議。希望能夠從源頭入手,推動高�？萍佳邪l(fā),促進科技成果的轉(zhuǎn)化。圍繞本文研究主題,本文主要就高校職務發(fā)明轉(zhuǎn)化機制的選題背景和意義、基本理論、制約轉(zhuǎn)化的因素、域外經(jīng)驗借鑒、完善建議等五個部分展開論述:第一章主要介紹了選題的背景和意義,即我國高校職務發(fā)明轉(zhuǎn)化率很低的現(xiàn)狀以及促進高校職務發(fā)明轉(zhuǎn)化對提高我國科技研發(fā)水平的意義。正是由于存在我國高校職務發(fā)明轉(zhuǎn)化率低的問題,進而才有必要對高校職務發(fā)明轉(zhuǎn)化進行研究并予以完善。第二章主要介紹了高校職務發(fā)明的相關概念、特點以及高校職務發(fā)明轉(zhuǎn)化機制的內(nèi)涵和要求。高校職務發(fā)明的概念、高校職務發(fā)明人的范圍、高校職務發(fā)明自身的特殊性;高校職務發(fā)明轉(zhuǎn)化機制的完善需要從法律、政策、高校自身管理制度三個層面入手,協(xié)調(diào)配合,才能全面促進高校職務發(fā)明轉(zhuǎn)化率的提升。第三章主要介紹了制約高校職務發(fā)明轉(zhuǎn)化的因素。主要包括法律、政策、高校自身管理制度等方面的不足。高校職務發(fā)明轉(zhuǎn)化有法可依,政策支持、導向正確,高校積極進行科技成果轉(zhuǎn)化,營造良好的科技成果轉(zhuǎn)化環(huán)境,才能促進高校職務發(fā)明轉(zhuǎn)化率的全面提高。第四章主要介紹了具有代表性的美國、英國、日本三個國家的高校職務發(fā)明轉(zhuǎn)化機制的相關經(jīng)驗,為完善我國高校職務發(fā)明轉(zhuǎn)化機制提供了啟示與借鑒。第五章主要介紹了完善高校職務發(fā)明轉(zhuǎn)化機制的建議,建議主要針對制約高校職務發(fā)明轉(zhuǎn)化的因素提出解決對策。主要分為三個方面:立法建議、政策建議和高校自身管理制度的建議。最后在論文的結(jié)論部分,筆者對文章進行了總結(jié):完善高校職務發(fā)明轉(zhuǎn)化機制需要法律、政策、高校自身管理制度三個方面的協(xié)調(diào)配合,為高校職務發(fā)明轉(zhuǎn)化營造良好的轉(zhuǎn)化環(huán)境,提高高校和教師研發(fā)和轉(zhuǎn)化的積極性,從而促進高�？萍汲晒D(zhuǎn)化率的提高。
[Abstract]:The university is a collection of a large amount of knowledge and development of local talent, is mainly according to the inventor of the invention creation, but also to promote China's scientific and technological innovation, an important place for output of scientific and technological achievements. Since the development strategy of innovation country, our legislation also gradually amended the relevant laws to promote science and technology innovation. The government response to the national call, R & D has issued a series of policies to encourage and support scientific and technological achievements of colleges and universities in the country and the government. A series of incentive measures, the number of China's University inventions also appeared explosive growth. But in contrast, the progress of market sectors inventions is unusually slow this paper intends to promote the University. Therefore, the invention to improve the conversion rate, makes a discussion on the perfection of University inventions transformation mechanism. In order to solve the problem, we must first identify the cause. Restrict the invention transforming factors of development and transformation of enthusiasm not only includes universities and the inventor is not high also includes a platform for the transformation of scientific and technological achievements transformation model is not perfect, not mature. But the author thinks that the University and its creator development and transformation of enthusiasm is not high is the invention causes the low conversion rate. Therefore, the excited the University and the inventor to create enthusiasm and transformation as the starting point of research and value orientation, and then puts forward a series of suggestions to improve the conversion mechanism. The invention can hope from the source into the hand, promote the development of science and technology, promoting the transformation of scientific and technological achievements. This paper focuses on the research topic, the basic theory of this paper in the invention the conversion mechanism of the background and significance, factors restricting the transformation of the foreign experience, the suggestions of five parts: The first chapter mainly introduces the background and significance of the topic, namely our country University invention conversion status is very low and promote the transformation of the invention improve the level of research and development of science and technology in China. It is because of the existence of our country University invention of the problem of the low conversion rate, and thus it is necessary to study and to be transformed the invention of perfect position. The second chapter mainly introduces the related concepts of the invention, the connotation and characteristics and the transformation mechanism of the invention. The invention of the concept of the scope of the inventor, college, high school invention own particularity; perfect the invention of transformation mechanism from law, policy, three a level of universities management system, coordination and cooperation, to fully promote the invention to enhance the conversion rate. The third chapter mainly introduces the position restricting the hair The factors of transformation. Mainly including law, policy, shortage of colleges and universities management system and so on. The invention into law, policy support, correct guidance, and actively carry out the transformation of scientific and technological achievements, to create a good environment for the transformation of scientific and technological achievements, to promote the invention to improve the conversion rate. The fourth chapter mainly introduces a the representative of the United States, Britain, Japan Post college experience three national invention conversion mechanism, to improve our college duty to provide inspiration and reference. The fifth chapter present transformation mechanism are introduced to improve the invention of transformation mechanism suggestion, proposal aimed at restricting University inventions transformation factors put forward countermeasures mainly divided into three aspects: legislative proposals, suggestions and recommendations of the management system of universities. Finally, in the conclusion part, the author of the This paper summarizes: perfect the invention transformation mechanism requires legal, policy, coordination of the three aspects of colleges and universities management system for colleges and universities, the invention to create a good environment for the transformation of the transformation, improve the enthusiasm of teachers and the development and transformation, so as to promote the transformation of scientific and technological achievements to improve the rate.
