【摘要】：因果關(guān)系是指原因與結(jié)果之間引起與被引起的聯(lián)系,在刑法中確定因果關(guān)系的意義就在于將危害結(jié)果歸責于行為人所實施的危害行為。因果關(guān)系理論是刑法學(xué)中的一個重要基礎(chǔ)理論問題,也是在實踐中所面臨的最為困難的問題之一。若要使之從徘徊中走出來,就要準確把握住刑法因果關(guān)系的實質(zhì)在于歸責,而不是歸因問題。在這個問題上,客觀歸責理論作為一個具有明確標準的歸責理論體系,可以在一定程度上有效解決實踐中所面臨的因果關(guān)系難題。 本文從以下幾個部分對因果關(guān)系理論進行分析探討,比對國內(nèi)外對這一問題的理論發(fā)展,從中找出解決因果關(guān)系問題的方法思路。 第一部分：對我國傳統(tǒng)因果關(guān)系理論的形成與發(fā)展進行總結(jié)和反思,從中反映出傳統(tǒng)因果關(guān)系理論從形成初期提出具有自己特色的理論深度到逐漸陷入哲學(xué)理論概念束縛的過程。 第二部分：對我國傳統(tǒng)因果關(guān)系理論進行闡述分析,特別是對“必然——偶然”因果關(guān)系的爭論進行探討,得出對傳統(tǒng)因果關(guān)系理論必須找到新的研究路徑才能進一步使之發(fā)展完善的觀點。 第三部分：對國外刑法因果關(guān)系理論進行評價分析,從中找出不同于我國因果關(guān)系理論的能夠有效解決因果關(guān)系問題的研究方法。即從對因果關(guān)系的事實層面研究轉(zhuǎn)向?qū)σ蚬P(guān)系的實質(zhì)法律層面研究,從歸因問題向歸責問題轉(zhuǎn)變。 第四部分：由于刑法因果關(guān)系的本質(zhì)在于歸責,因此,對刑事責任與因果關(guān)系的聯(lián)系、責任的本質(zhì)問題進行研究分析。 第五部分：對解決因果關(guān)系問題具有指導(dǎo)意義的客觀歸責理論進行分析探討,包括客觀歸責的理論原理、基本構(gòu)造、判斷模式、體系地位等問題。
[Abstract]:Causation refers to the relationship between cause and result, and the significance of determining causation in criminal law lies in imputing the harm result to the harm behavior carried out by the actor. Causality theory is not only an important basic theory problem in criminal law, but also one of the most difficult problems in practice. If we want to make it out of the wander, we must grasp the essence of causality in criminal law, not attribution. On this issue, objective imputation theory, as a system of imputation theory with clear criteria, can solve the problem of causality in practice to a certain extent. This paper analyzes and discusses the theory of causality from the following parts, compares the theoretical development of this problem at home and abroad, and finds out the methods to solve the problem of causation. The first part is a summary and reflection on the formation and development of the traditional causality theory in China. It reflects the process of the traditional causality theory from the theoretical depth with its own characteristics in the early stage of formation to gradually fall into the bondage of the philosophical theory concept. The second part: expounding and analyzing the traditional causation theory of our country, especially discussing the argument of "necessity-chance" causality. It is concluded that the traditional causal relationship theory must find a new research path in order to further improve its development. The third part evaluates and analyzes the theory of causation in foreign criminal law, and finds out the research methods which can effectively solve the problem of causation, which are different from the theory of causality in our country. That is, from the de facto study of causal relationship to the substantive legal level of causal relationship, and from attribution to imputation. The fourth part: because the nature of causation in criminal law is imputation, therefore, the relationship between criminal responsibility and causation, and the essence of liability are studied and analyzed. The fifth part analyzes and discusses the theory of objective imputation which is instructive to solve the problem of causation, including the theoretical principle of objective imputation, the basic structure, the mode of judgment, the status of the system and so on.
