【摘要】：電信網(wǎng)絡(luò)詐騙作為一種新的詐騙犯罪類型,近年來詐騙手法不斷演變更新,案件取證難度不斷加大,造成案件審理過程中常常遇到詐騙數(shù)額、主觀明知、既遂與未遂、一罪還是數(shù)罪、主從犯、涉案財物處理等法律適用和事實認(rèn)定的審理難題。日前,"兩高一部"下發(fā)的《關(guān)于辦理電信網(wǎng)絡(luò)詐騙等刑事案件適用法律若干問題的意見》為部分審理難題的處理提供了有效指引和解決出路,但受相關(guān)規(guī)定的內(nèi)容有限且電信網(wǎng)絡(luò)詐騙犯罪行為的特殊性等因素影響,實踐中仍面臨不少審判難題亟待研究處理。本文結(jié)合A市法院的審判實際,深入研究應(yīng)對該意見實施之后的新情況、新問題,統(tǒng)一認(rèn)識,規(guī)范做法,確保案件審判實現(xiàn)政治效果、法律效果、社會效果的高度統(tǒng)一。
[Abstract]:Telecommunication network fraud, as a new type of fraud crime, has been evolving and updating in recent years, and the difficulty of obtaining evidence in the case has been increasing, which often results in the amount of fraud, subjective knowing, accomplished and attempted in the process of trial of the case. A crime or a number of crimes, principal and accessory, the handling of property involved in the application of the law and the facts of the trial difficult problems. A few days ago, the "opinions on certain legal issues applicable to handling Criminal cases such as Telecommunication Network Fraud" issued by the "two High Schools and one Edition" provided effective guidance and solutions for dealing with some of the difficult problems in trial. However, due to the limited content of the relevant regulations and the particularity of the telecom network fraud crime and other factors, there are still many trial problems that need to be studied and dealt with in practice. Combining with the trial practice of A City Court, this paper deeply studies the new situation, new problems, unified understanding and standardized practices after the implementation of this opinion to ensure the high unity of political effect, legal effect and social effect in the trial of a case in order to realize the political effect, the legal effect and the social effect.
