我國精神病人強制醫(yī)療制度研究

【摘要】：目前,我國精神病人數(shù)量呈上升趨勢,由精神病人引起的肇事事件已經(jīng)越來越凸顯出我國公共衛(wèi)生問題和社會問題的嚴峻形勢,需采取有效而明確的處理措施。精神病人強制醫(yī)療措施是一項特殊的社會安全措施,措施本身既涉及到精神病人的人身自由權(quán)和健康權(quán)利,又涉及到社會安全和社會秩序。目前我國精神病人強制醫(yī)療措施存在適用對象范圍狹窄、審理方式不明、精神病司法鑒定混亂等問題,本文通過介紹國外精神病人強制醫(yī)療制度,結(jié)合相關(guān)法律條文,提出完善我國精神病人強制醫(yī)療的建議,以期待我國精神病人強制醫(yī)療制度更加具有實踐操作性。
[Abstract]:At present, the number of mental patients in China is on the rise, and the incident and accident caused by the mental patients have increasingly highlighted the serious situation of public health problems and social problems in our country, and the effective and clear treatment measures need to be taken. The compulsory medical treatment of mental patients is a special social security measure, which is not only related to the personal liberty and the right of the mental patients, but also to the social security and social order. At present, the compulsory medical treatment of the mental patients in our country is subject to the problems of the narrow scope of the applicable subject, the unclear way of the trial, the confusion of the mental identification of the mental illness, etc. The article introduces the compulsory medical system of the mental patients in the foreign countries, and combines the relevant legal provisions. The author puts forward the suggestion to improve the compulsory medical treatment of the mental patients in our country, in order to expect the compulsory medical system of the mental patients in our country to be more practical.
