【摘要】：新《食品安全法》規(guī)定了全面、嚴(yán)格的法律責(zé)任,更樹立起刑事責(zé)任優(yōu)先的法律理念。刑事責(zé)任優(yōu)先是對(duì)刑法謙抑原則的相對(duì)突破。食品安全犯罪是典型的法定犯,與某些食品安全違法行為表現(xiàn)一致、特征相符,導(dǎo)致實(shí)踐中出現(xiàn)行刑不分、以罰代刑的責(zé)任混淆,亟須甄別兩種不同責(zé)任承擔(dān)方式。在此基礎(chǔ)上,堅(jiān)持刑事責(zé)任優(yōu)先的法律理念,需要在理念層面上采納"刑罰優(yōu)先適用說",在操作層面上完善行政違法行為與食品安全犯罪的執(zhí)法、司法案件相互移送和結(jié)果互認(rèn),整體上實(shí)現(xiàn)對(duì)食品安全違法犯罪行為的有效規(guī)制。
[Abstract]:The new Food Safety Law stipulates comprehensive and strict legal liability and sets up the legal concept of criminal liability first. The priority of criminal responsibility is a relative breakthrough to the principle of modesty in criminal law. Food safety crime is a typical legal offense, which is consistent with some illegal food safety behaviors and the characteristics are consistent, which leads to the confusion of the responsibility of execution and punishment in practice. It is urgent to identify two different ways of taking responsibility. On this basis, to adhere to the legal concept of criminal responsibility priority, we need to adopt the "penalty priority application theory" at the conceptual level, and improve the law enforcement of administrative illegal acts and food safety crimes at the operational level. Judicial cases are transferred to each other and the results are recognized each other, so as to achieve effective regulation of food safety crimes.
