【摘要】：刑法合憲性解釋不同于傳統(tǒng)法律解釋論中的體系解釋和目的解釋,也不屬于違憲審查制度的范疇,而是刑法體系或者目的之外,根據憲法條文包含的刑法規(guī)范或者背后的憲法價值,分析整體法律系統(tǒng)或者目的,對刑法條文作出解釋。在對刑法條文進行合憲性解釋時,需要根據平衡原則,對公民自由權利與公共秩序利益進行考量,作出適當的選擇,從而確定特定具體危害行為是否應當處罰。在不當罰的考量上,宜側重社會對該行為的容忍程度;在當罰性的考量上,則側重該行為的危害程度情況和多發(fā)可能性。從位階上看,刑法合憲性解釋并不屬于傳統(tǒng)法律解釋論所界定的論理解釋,而是處于具有統(tǒng)轄作用的更高地位。
[Abstract]:The constitutional interpretation of criminal law is different from the system interpretation and the purpose interpretation in the traditional theory of legal interpretation, and does not belong to the category of unconstitutional review system, but is outside the criminal law system or purpose.According to the criminal law norms contained in the constitution or the constitutional value behind it, this paper analyzes the whole legal system or purpose, and interprets the criminal law provisions.In the constitutional interpretation of the articles of criminal law, it is necessary to consider the civil rights of liberty and the interests of public order according to the principle of balance, and make appropriate choices, so as to determine whether the specific harm behavior should be punished.In the consideration of improper punishment, it is advisable to focus on the degree of tolerance of the behavior in society, and on the degree of harm and the possibility of occurrence of the act in the consideration of appropriate punishment.From the perspective of rank, constitutional interpretation of criminal law does not belong to the theoretical interpretation defined by the traditional theory of legal interpretation, but is in a higher position with the function of governing.
