【摘要】：國務(wù)院法制辦于2014年5月發(fā)布了《中華人民共和國無線電管理條例(修訂草案)(征求意見稿)》,將無線電頻率和衛(wèi)星軌道資源明確規(guī)定為無線電管理條例保護的對象,這無疑給刑法提出了新問題。為了維護無線電通訊秩序,中國1997年《刑法》增設(shè)了第288條擾亂無線電通訊管理秩序罪,但此罪在犯罪成立的條件上要求過高、在司法實踐的認定上存在困難,幾乎淪為"廢條"�！缎谭ā芬l(fā)揮保護無線電頻率和衛(wèi)星軌道資源的作用,就必須根據(jù)現(xiàn)實的需要對第288條做出適當(dāng)?shù)男薷?使其走出"廢條"困境。
[Abstract]:In May 2014, the legal Affairs Office of the State Council issued the regulations of the people's Republic of China on Radio Administration (revised draft), which explicitly defined radio frequencies and satellite orbit resources as the objects protected by the regulations. In order to maintain the order of radio communication, the Chinese Criminal Law in 1997 added the crime of disturbing the order of radio communication management by article 288, but this crime requires too much on the condition of the establishment of the crime. In order to protect radio frequency and satellite orbit resources, it is necessary to make appropriate amendments to article 288 in accordance with the actual needs, in order to play a role in protecting radio frequency and satellite orbit resources, there are difficulties in the determination of judicial practice, and they are almost reduced to "scrap articles." Make it out of the "scrap" dilemma.
