【摘要】：從概率論的視角看,證據(jù)與待證命題是否相關(guān),取決于證據(jù)能否改變法官對命題為真的概率評價(jià),證明力的大小則取決于這種改變的程度。似然率模型是一種評價(jià)證據(jù)證明力的量化方法,它可以統(tǒng)一描述證據(jù)"能否"以及在"何種程度"上影響人們對待證命題為真的概率評價(jià)。似然率模型有助于法官心證形成過程的明示化、規(guī)范化和科學(xué)化,對防止法官濫用自由裁量權(quán)具有重要的現(xiàn)實(shí)意義和應(yīng)用價(jià)值。許多國家普遍應(yīng)用似然率模型以評價(jià)DNA證據(jù)的證明力,但有更多問題尚待進(jìn)一步研究。
[Abstract]:From the point of view of probability theory, whether the evidence is related to the propositions to be proved depends on whether the evidence can change the judge's evaluation of the true probability of the propositions, and the power of proof depends on the degree of such changes. Likelihood rate model is a quantitative method to evaluate the power of proof. It can describe whether the evidence can be proved or not and to what extent it can influence the probabilistic evaluation of the propositions to be proved. The likelihood rate model is helpful to the ostensibility, standardization and scientization of the forming process of the judge's psychological evidence, and has important practical significance and application value to prevent the judge from abusing the discretion. In many countries, likelihood rate models are widely used to evaluate the probative power of DNA evidence, but more problems need to be further studied.
