【摘要】：行政訴訟目的是解決行政爭議,從而保護(hù)行政相對人的合法權(quán)益,監(jiān)督行政機(jī)關(guān)依法行政,但是由于行政管轄的“原告就被告”原則并不能滿足行政管轄的“兩便原則”,同時也給地方政府干預(yù)司法提供了便利條件,行政訴訟目的無法實(shí)現(xiàn),針對其所帶來的問題,實(shí)踐中也對行政案件管轄做了一系列的改革,但是其并不能完全排除地方保護(hù),反而會帶來新的問題。文章以中級法院設(shè)置巡回行政法庭的基本理論出發(fā)。通過分析現(xiàn)行改革方案中存在的增加原告“訴累”、訴訟成本增多的不足及原因,提出中級人民法院設(shè)置巡回行政法庭的必要性:即可以實(shí)現(xiàn)提級管轄又可以方便訴訟,滿足行政案件管轄的內(nèi)在需求;中院設(shè)置巡回行政法庭即有法律依據(jù),在實(shí)踐中也是可行的。同時,對英國巡回審判制度進(jìn)行分析,不僅要借鑒依靠群眾、發(fā)動群眾,深入調(diào)查案件,把矛盾化解在基層,減輕當(dāng)事人訴累的經(jīng)驗(yàn),更要以順應(yīng)時代發(fā)展為啟示;具體列出巡回行政法庭的審理標(biāo)準(zhǔn)與審理范圍,建立從人員和財(cái)政再到辦案質(zhì)量的制度保障,保障中級人民巡回行政法庭獨(dú)立、公正審理行政案件,實(shí)現(xiàn)行政訴訟目的。
[Abstract]:The purpose of administrative litigation is to resolve administrative disputes, thus to protect the legitimate rights and interests of administrative counterpart and to supervise the administration of administrative organs according to law. However, since the principle of "plaintiff on defendant" in administrative jurisdiction cannot satisfy the principle of "two means" in administrative jurisdiction, At the same time, it also provides a convenient condition for the local government to intervene in the judicature, and the purpose of administrative litigation cannot be realized. In view of the problems brought about by it, a series of reforms have been made on the jurisdiction of administrative cases in practice, but it can not completely exclude local protection. On the contrary, it will lead to new problems. The article starts from the basic theory that the intermediate court sets up the circuit administrative court. By analyzing the deficiency and reason of increasing the plaintiff's "litigation tiredness" and increasing the litigation cost in the current reform scheme, this paper puts forward the necessity for the intermediate people's court to set up the circuit administrative court, that is, it can realize the promotion of jurisdiction and facilitate the litigation. The intermediate people's court has the legal basis to set up the circuit administrative court, which is also feasible in practice. At the same time, the analysis of the British circuit trial system should not only draw lessons from the masses, mobilize the masses, deeply investigate the cases, resolve the contradictions at the grass-roots level, reduce the litigants' tiredness, but also take the development of the times as an inspiration. The trial standard and scope of the circuit administrative court are listed in detail, the system guarantee from personnel and finance to the quality of handling cases is established, the independence of the intermediate people's circuit administrative court is guaranteed, the administrative case is tried fairly, and the purpose of administrative litigation is realized.
