司法公開語境下的減刑假釋程序完善

【摘要】:減刑假釋是我國在改造罪犯的實踐中逐步建立起來的具有我國特色的刑罰執(zhí)行制度。我國的減刑假釋制度,經過長期實踐和不斷完善,在刑罰執(zhí)行方面起到了極為重要的作用。然而現行的減刑假釋制度,還存在著種種缺陷。這些缺陷,使得減刑假釋猶如在‘暗箱”中操作運行,成為影響司法公開公正的一大屏障。 第一部分減刑假釋的性質、功能以及權力屬性。減刑對罪犯本人具有積極的引導作用,能夠穩(wěn)定監(jiān)獄監(jiān)管秩序,還對原判刑罰起到一定調控作用;假釋除了具有上述功能外,還具有培養(yǎng)罪犯的自律意識及能力、作為罪犯從身陷牢獄到完全融入社會的過渡作用。減刑假釋權不僅僅是國家的刑罰執(zhí)行權力,同時也是罪犯在認罪悔罪認真改造的前提下應當享有的一項權利。在權力歸屬上,減刑假釋權在司法實質上是刑罰變更,系司法判斷權的范疇,故應該屬于司法權。 第二部分減刑假釋的產生與發(fā)展。在減刑制度的發(fā)展歷程中,出現了善時制、不定期刑、累進處遇、假釋等形式的行刑制度,假釋制度在世界范圍的廣泛實行,受了目的主義、主觀主義的影響。 第三部分減刑假釋程序的現狀以及存在的缺陷。根據我國現行法律規(guī)定,刑罰執(zhí)行機關是減刑假釋建議的提請機關,其它任何組織和個人都無權提請。在審判階段,案件的審理方式以書面審理為主,開庭程序較為簡單,缺乏檢察機關的有效監(jiān)督。在這樣的程序下,罪犯和被害人的權利得不到保障。審判階段大量采用書面審理方式、裁判文書千篇一律、開庭程序較為簡單,這種不透明的程序設計,雖然提高了司法效率,但在實質層面卻影響了司法公正,導致了司法權威的喪失。檢察機關的監(jiān)督操作難,并且具有滯后性,缺乏有效的監(jiān)督手段,從而有可能造成司法腐敗。 第四部分完善減刑假釋程序的設想。要想完善程序,需要構建多方參與的減刑假釋提請程序,賦予罪犯一定的提請權。構建公開透明的審判程序,加大開庭審理比例,完善開庭審理程序,保障罪犯、被害人以及律師的參與權。增加裁判結果透明度,提高文書質量,推動減刑假釋裁定上網。完善和改革檢察機關對于減刑假釋案件的檢察監(jiān)督,構建貫穿減刑假釋各個階段的同步監(jiān)督體系。加強各單位溝通交流,構建暢通的減刑假釋辦理機制。
[Abstract]:Commutation and parole is a penalty execution system with Chinese characteristics, which is gradually established in the practice of reforming criminals. The commutation and parole system of our country has been practiced and improved for a long time. However, the current commutation and parole system still has a variety of defects. These defects make commutation and parole operate as if in the 'dark box'. To become a barrier to judicial openness and justice. The first part is about the nature, function and power attribute of commutation and parole. Commutation plays a positive role in guiding the criminal himself, stabilizing the prison supervision order and regulating the original sentence. It also has the ability to cultivate the self-discipline of criminals, as the transitional role of criminals from imprisonment to full integration into society. The right of commutation and parole is not only the state's power to execute punishment. At the same time, it is also a right that criminals should enjoy under the premise of serious reformation of guilty repentance. In power attribution, the right of commutation and parole is essentially a change of punishment, which belongs to the category of judicial judgment, so it should belong to judicial power. The second part is about the emergence and development of commutation and parole. In the development of commutation system, there are some forms of execution system, such as good time system, indefinite punishment, progressive punishment, parole and so on, and the parole system is widely implemented in the world. Under the influence of objectivism and subjectivism. The third part is about the current situation of commutation and parole procedure and its defects. According to the current law of our country, the penalty enforcement organ is the requesting organization for commutation and parole proposal, and no other organization or individual has the right to bring it to the court at the trial stage. The trial mode of the case is mainly written trial, the procedure of the court session is relatively simple, and the effective supervision of the procuratorial organ is lacking. Under such procedure, the rights of the criminal and the victim are not guaranteed. In the trial stage, a large number of written hearing methods are used. The judicial documents are uniform, and the procedure of the court session is relatively simple. Although the opaque procedure design has improved the judicial efficiency, it has affected the judicial justice on the substantive level, resulting in the loss of judicial authority, and the supervision and operation of the procuratorial organ is difficult. And lag, lack of effective means of supervision, which may lead to judicial corruption. The fourth part is to perfect the procedure of commutation and parole. In order to perfect the procedure, it is necessary to construct a multi-participation commutation and parole application procedure, to give the criminal the right to request, to construct an open and transparent trial procedure, and to increase the proportion of court hearings. To improve the hearing procedures in court sessions, to protect the participation rights of criminals, victims and lawyers, to increase the transparency of adjudication results, to improve the quality of documents, to promote the use of the Internet for commutation and parole rulings, and to perfect and reform the procuratorial supervision of commutation and parole cases by procuratorial organs. Construct the synchronous supervision system running through each stage of commutation and parole, strengthen the communication and exchange among various units, and construct a smooth mechanism of commutation and parole management.
